Court officials are trying to determine how many and which original files ar=

The court worker contacted police about 3 p.m. on Dec. 3. Police then saw th=

documents on Dec. 9 and interviewed the ex-boyfriend.=20
Investigators then took the documents to Jeffrey Ward, the administrative=20
clerk of the court, who verified that the papers were not supppose to leave=20
the courthouse, the source said.

Paterson will give The Record code violation information

The City of Paterson will provide The Record with public documents the=20
newspaper sought in a lawsuit filed last month, according to an agreement=20
reached at a court hearing Friday.=20
The suit charged that the city refused to allow a reporter access to health-=
=20
and building-code violations for about 250 houses and apartments. The units=20
are being used to relocate residents from two city housing projects that wer=
e=20
targeted for demolition.=20
City officials told the reporter that only city employees could conduct the=20
search of records and review the information, and that The Record would be=20
charged for the employees=92 time, the suit claimed.=20
Friday=92s agreement does not resolve that issue=97the major sticking point=20=
in=20
the case.=20
If the city decides to implement those charges, both sides could wind up=20
before state Superior Court Judge Frank Donato.=20
The Record=92s attorney, Tom Cafferty, said those seeking public documents=
=97from=20
private citizens to news agencies=97are only required to pay for photocopies=
=20
under the state=92s Right to Know law. While city attorneys have pointed to=20
case law that allows other charges beyond copies, Cafferty said that does no=
t=20
apply to this case.=20
=93The basic problem is that people in government think that it=92s not thei=
r job=20
to provide these records to the public,=94 said Cafferty. =93When the day is=
=20
done, it is their job=97these are the public=92s records.=94=20
Ray Vivino, the attorney who represented the city, did not say whether the=20
city will pursue the additional costs. Vivino said the paper=92s request is=20=
an=20
extensive one that will require a city worker to help the reporter pull=20
thousands of files from several city agencies.=20
