Re: handheld scanners



I had this message forwarded to me and I wanted to make a comment regarding this case.

I issued a directive to the town clerks regarding the use of hand held scanners in town vaults, indiciatiing that according to vault regulations, this type of equipment was not permitted in a vault. Someone challenged this and brought the case before the state FOI commission.

The commission "overturned" my opinion.

The City of Hartford has appealed this decision to the Superior Court. No decision has been rendered so far.

There is a case pending in the Conn. Supreme Court on this issue which may
be of interest to some folks.  In May, 1999, Hartford City Clerk Dan Carey
barred a title researcher from his land record vault for using a hand-held
scanner on records and thereby avoiding the $1 per document copy fee which
generates income for the City.

According to the newsletter of the New England Association of City and Town
Clerks, Dan received conflicting opinions from the state's Public Records
Administrator and the Freedom of Information Commission and is awaiting a
date with the state Supreme Court to rule on the issue.

(Under NH state law, we charge a "search fee," not a "copy fee," for vital
records and provide a certified copy of the document when found or a
certified letter stating that the document was not found.  Our vital records
are in "closed stacks."  Maybe some of these issues will ultimately be
addressed "semantically"?)
