Use of Images for Artwork



Fellow archivists,

I have an unusual and confusing (at least to me!) situation.  An artist, who
had a show in town, was asked by some retirees from my institution if he
would consider doing some painting of SCSU-related scenes, and they
suggested a particular image.  This image depicts an early entrance to the
campus, affectionately known as "the arch."  I gave him a copy of the image
before I had really thought about the situation, because to me, it seemed
almost like anyone else asking for a copy of an image for reference
purposes.  The difference in this case is that he will create an original
artwork based on the image.

My question is:  Should we charge him sort of use fee?  We charge a fee for
people wishing to use our images in publications, but this isn't exactly a
publication, is it?  And, he will not be selling copies of our image, but
copies of his own artwork, which was based on the image.

Any experience with similar situations or any guidance anyone can offer will
be much appreciated.
