Title: An assessment of sentencing strategies for managing serious and violent juvenile offenders

Abstract: The primary purpose of this study was to determine the effectiveness of two sentencing strategies for managing serious and violent juvenile offenders: judicial waiver to adult court and determinate sentencing in juvenile court. Two data sets were collected and analyzed in this study. First, data were collected on all juveniles waived to adult court from 1981-1993 and subsequently sentenced to the Texas Department of Criminal Justice-Institutional Division (TDCJ-ID) (N = 946). Second, data were collected on all juveniles determinately sentenced in juvenile court from 1987-1993 (N = 358).

This study found that juveniles waived to adult court and sentenced to TDCJ-ID are much more likely to have committed a violent offense than a property or other non-violent felonious offense, while those determinately sentenced in juvenile court had all committed a violent offense. In addition, both groups consistently received longer terms of incarceration than were available through normal juvenile justice processing. When actual time served was taken into consideration, however, most juveniles in both groups did not serve sentences in excess of what they could have received if processed normally in the juvenile justice system. Furthermore, when the two groups were compared, juveniles determinately sentenced in juvenile court were more likely to be younger and receive and serve shorter sentences than juveniles waived to adult court and sentenced to TDCJ-ID.
