Title IV, SEC. 4135. EXPANSION OF CENTERS OF EXCELLENCE. (a) In General. The Secretary of Health and Human Services shall use a competitive process to contract with centers of excellence for cataract surgery and such other services as the Secretary determines to be appropriate. Payment under title XVIII of the Social Security Act will be made for services subject to such contracts on the basis of negotiated or all-inclusive rates as follows: (1) The center shall cover services provided in an urban area (as defined in section 1886(d)(2)(D) of the Social Security Act) for years beginning with fiscal year 1995. (2) The amount of payment made by the Secretary to the center under title XVIII of the Social Security Act for services covered under the project shall be less than the aggregate amount of the payments that the Secretary would have made to the center for such services had the project not been in effect. (3) The Secretary shall make payments to the center on such a basis for the following services furnished to individuals entitled to benefits under such title: (A) Facility, professional, and related services relating to cataract surgery. (B) Coronary artery bypass surgery and related services. (C) Such other services as the Secretary and the center may agree to cover under the agreement. (b) Rebate of Portion of Savings. In the case of any services provided under a demonstration project conducted under subsection (a), the Secretary shall make a payment to each individual to whom such services are furnished (at such time and in such manner as the Secretary may provide) in an amount equal to 10 percent of the amount by which (1) the amount of payment that would have been made by the Secretary under title XVIII of the Social Security Act to the center for such services if the services had not been provided under the project, exceeds (2) the amount of payment made by the Secretary under such title to the center for such services.
