Title XI, SEC. 11002. ENFORCEMENT. (a) In General. Any health insurer or health benefit plan sponsor that violates a requirement of this title shall be subject to civil money penalties of not more than $25,000 for each such violation. The provisions of section 1128A of the Social Security Act (other than subsections (a) and (b)) shall apply to civil money penalties under this subparagraph in the same manner as they apply to a penalty or proceeding under section 1128A(a) of such Act. (b) Equitable Remedies. (1) In general. A civil action may be brought by the applicable Secretary (A) to enjoin any act or practice which violates any provision of this title, or (B) to obtain other appropriate equitable relief (i) to redress such violations, or (ii) to enforce any provision of this title, including, in the case of a wrongful termination of (or refusal to renew) coverage, reinstating coverage effective as of the date of the violation.
