The following info. is just FYI.

1. You are not alone.  Almost all LADs in Kansas area have not received
   anything from Kansas city INS.  The thing is many lucky LADs put some
   info. on this net while most unlucky ones keep quiet on the net, so it
   seems most LADs have got an interview or a approval but unfortunately it
   is not true. As I know, a lot of LADs have not got anything from the
   local INS since sending the applications.

2. You are right. The F visa holders do NOT allow to have dual intentions.
   i.e. either keep your nonimmigration F visa without applying PR or apply
   PR but the F visa will be gone automatically.

Hello, welcome to the Chinese Biotechnology Network!

The Chinese Biotechnology Network (abbreviated as CB-Net) is registered as
a non-profit organization with a purpose to serve YOU, if you are in the
fields of biological, chemical or medical sciences, or if you simply have
the interest to hear us and to talk to us.  By doing so, YOU become US.

How do we serve us, including you?  Well, you've heard of the CB-Net now,
and you figure there are more people know us just like you.  Everyone
carries a unique set of information.  If we share, we'd all become richer
in our info possession.  You offer your share because you need someone
else's at some time.  To rephrase the famous Confucian notion, you better do
it to the others if you want the same done to you.  A frequent truth, WHAT
WE WANT IS AMONG US.

In addition to sharing information, we communicate to inspire each others,
to synergize our efforts, and to form a unity with more powerful voices.

The Net is internet-based, and E-mail circulation is our primary activity
at this stage.  We will have:
        * regular briefing on advances in related fields
        * R&D news and articles
        * member input and communication
        * forum, discussions
        * special reports
        * survey: opinions, product quality, prices => recommendations
        * experiment key and protocol recommendation
        * Q & A

We also plan to install databases such as:
        * personnel database: You'll be able to locate your old
	  friends, someone in your field that you may want to talk to, 
	  or some "insiders" who can provide you crucial information 
	  of the institutions in your post-doc position list.
        * job database:  with location index, for instance, so you
          can find something in your dream city.
        * CBIF archive:  if you miss any issue that you have deleted, 
          just login and search through the master copy that we keep.

To deserve these privileges, please participate, which means to
provide your personal file (form enclosed) so that your college roommate
can search for you; to contribute job ad if you know any.  Not much to
give for the vast resources you are offered, isn't it?

At certain stage, we will organize more activities to promote direct
member interactions and plant collaboration seeds.  We shall mobilize our
collective strength and speak for any or all of us in case of need.

Our net has no limit.  It will reach our colleagues in other continents,
certainly and notably, the land that we are from, which is hailed as a
land of economic miracle and boom.  Opportunities? we'll see.

My sister just came back from China with her CSPA I-551 stamp. No questions
were asked by either costum officials. Hope this example clarifies the
situation. Of course I can not guarantee everybody's travel is trouble-free.

approved, stamped, and even plastic card issued by INS! (I am still waiting to 
be plastic card issued!) 

In different states, lads may have to wait much longer than the others.

Can anybody answer this: is it true that it becomes more difficult
to get new F/J-1 visa issued in China? Does CSPA have any impact

I do not think so, absolutely no. It depends on where you live, how
well your case is presented, and the examiner. If the examiner takes
a break, say, a vocation to China, then you have to wait until he/she
comes back.

For your information only: Mr. Bai, the consulor in Education at
Consulate General in Houston told me about 1 month ago that for 
those PRs who holds passport issued from the Ministry of Foreign 
Affairs such as former J-1 visa holder, there will be trouble going 
out of China with US Green Card, but no problem going into China.  
Those passport holders are encouraged to change to passport for 
private purposes (under the condition that one clarifies financial 
obligations with former employer or government agency sponser, i.e., 
pay money back).

Comments: this would discourage former J-1 holder from visiting
China in the near future.  

Exchange of information on this issue is appreciated.

Just saw a netter's posting about former J-1 / public passport stuff.

Here I would add that, my sister had J-1 with private passport (self-sponsored
J-1). So this may be one of the reasons for her trouble free trip to China.
Anyone with public passport please pay attention to the potential trouble
when getting out of China. Besides, I believe it is proper to pay back the 
money to your units or the state when you decide to stay in the U.S. Otherwise
it is not fair!

I have a question and hope to hear your advice as soon as possible. Thank you
all in advance.

My wife and I are both CSPAers and PR now. Our son came in Dec. 1991 on F-2.
When I graduated in May 92, he got Voluntary Departure from a local INS.
We did not know what VD was then and the INS officer told us our son could
change status later on. His application for PR was rejected as he would turn
21 at the end of AUG, 93. He is a FULL-TIME student now. He applied for F-1
and the receipt was dated 8/30/93.

More than 3 months passed with no approval notice and his VD expires on 1/1/94.
What should be done?

    a. Do nothing but wait? (2 more letters are sent without response. I called
       the whole morning today at INS Southern and cannot get through. Recorded
       message always the same"...should be processed within...60 days.")
       We have filed I-130 for him. Could that be a reason for the delay or
       even rejection of F-1 adjustment?

    b. Apply extension of VD? Will it be rejected?

    c. What is the implication for this? Will departure be the only outcome
       if.... Any one gets into similar situation?

WHAT should be done? Any advice, comment, suggestion will be appreciated.

Last night, Mi Mi Jr. arrived at JFK Internaional Airport happily and
healthy. It took her three hours to pass the custom, but the INS spent only
1 minute on her. She jumped and sat on the Immigration counter, looked and
smiled at the officer, and everything was okay. She got an F-2 visa, three
days before the expiration date (it was issued on June 15, 1993, when her
dady was still an F-1 student). Since she is eligible for CSPA herself,  
she is going to apply as a principal on her own. If not, an EB-3 follow
to join or FB-2 will not take much effect on her, since she is only 9!

During her 18 months' stay in China, she became the second in Chinese 
in her class, as a third grader. I hope she will not forget her Chinese.

Although Mi Mi Jr. has successfully arrived in NYC, some other kids are
not so lucky. That was why Mi Mi Sr. had been pushing so hard on the 
petition drive. Now, since there is not much to do with the extention of
CSPA, we may push the family unity in two other ways. One is the family
unity law pending in the congress, which, may waive all the infamous 
"immigration intention" for all the PR dependents, and, try to use
the state department's cable to pave the way for your dependents
by yourselves.

For the first option, we can moblize all the PRs from all over the world 
to lobby our senators, by now. Fighting between LADS and LCs ia a zero
sum game. Fighting through the congress hurts nobody and benefits all.

For the second option, you can ftp the cables from spike and get well
prepared for yourself before trying again. The specified effective time
for that two cables is up and until 1/1/94. There is not much time left 
for you to try that option. No one expects a miracle, but never stop 
trying!

Congratulations for your family union. I wish I could arrange a thing as
perfect as you did. I was told that my daughter was denied for applying a
B-2 visa last Friday. It was a mistake to let her go back China last year,
but it was the best choice at that moment. I had promised her to come back 
to me in about a year, but now I don't know how long we are going to suffer
the seperation, 2 years, 3 years, or 5 years. I feel so helpless. I wish
I could do something. But how could I?! I just don't understand that this
is a country supposed to protect human rights, why she has a such stupid
law to prohibit children to see their natural parents!!! She's only a 7
years old kid, she needs her parents.

Please help me to post it and give me some suggestions. I would like to do
anything if it can make my daughter come soon.

   I am a LAD and I was registered as a F-1 student. Ten days ago, I went
   to the local INS for the interview for PR. I got a pending notice. Then
   I went to the university register office to apply for in-state tuition,
   and I received the approval letter in the same week. It is said in the
   letter that I can pay only in-state tuition and my fall tuition
   charged for out-state will be refund. (I requested the residency
   starting from Fall 1993.) I post this info to let you know that LAD
   can also apply for in-state tuition if they qualify.

   Thanks for the LAD and Tuition nets. They helped me a lot.

Anyone knows that the provision of law '274A.13(C)(09)'?
It appears on LAD's Employment Authorization card.

I went by Kansas City INS to ask about LAD's I-485 process. An
officer told me she could not know how long it would take. 'There
are too many people', she said.

You will receive a letter from Guangzhou asking you to send them
your dependents' name, address, both in Chinese and English, their 
relationship with you, in order to process their visa application.
I just got such one, concerning my Mi Mi Jr.'s I-824 case.

It takes quite a long while, I think. 

Mi Mi Jr. has just got into a new Talented and Gifted Program in 
NYC's public school system. I took her to the board of education, 
showed them Mi Mi Jr.'s school records both in China and US, the 
very impressive City Wide Test records, and they immidiately 
sent us to the best public program in town. She is going to her new
school tommoror.

        To amend the Immigration and Nationality Act to permit the admission
           to the United States of nonimmigrant students and visitors who are
           the spouses and children of United States permanent resident aliens,
           and for other purposes.

                Be it enacted by the Senate and House of Representatives of the
           United States of America in Congress assembled,


        SECTION 1. ADMISSION OF CERTAIN "B" AND "F" VISA NONIMMIGRANTS WHO ARE
                   SPOUSES OR CHILDREN OF UNITED STATES PERMANENT RESIDENT
                   ALIENS.
           Section 212 of the Immigration and Nationality Act (8 U.S.C.
        1182) is amended by adding at the end thereof the following new
         subsection:

           (o)(1) Notwithstanding any other provision of law, no alien---

           (A) who is the spouse or child of an alien lawfully admitted for
               permanent residence to the United States,
           (B) who seeks admission to the United States for purposes of
               visiting the permanent resident spouse or parent or for studying
               in the United States, and
           (C) who is otherwise qualified,

        may be denied issuance of a visa, or may be denied admission to the
        United States, as a nonimmigrant alien described in section
        101(a)(15)(B) who is coming to the United States temporarily for
        pleasure or as a nonimmigrant alien described in section 101(a)(15)(F).

                    (2) Whenever an alien described in paragraph (1) seeks
        admission to the United States as a nonimmigrant alien described in
        section 101(a)(15)(B) who is coming temporarily for pleasure or as a
        nonimmigrant alien described in section 101(a)(15)(F), the fact that a
        petition has been filed on the alien's behalf for classification of the
        alien as an alien lawfully admitted for permanent residence shall not
        constitute evidence of the alien's intention to abandon his or her
        foreign residence.

                    (3) Notwithstanding any other provision of law, any alien-

           (A) who is issued a nonimmigrant visa under paragraph (1),
           (B) who was admitted to the United States,
        and
           (C) who remains in the United States longer than the period
        authorized for such nonimmigrant status,

        shall be ineligible to receive an immigrant visa for a period of up to
        one year after the alien's priority date has been reached, as the
        Secretary of State may determine.

Here are some questions posted on behalf of a person who can not access

The CSPA principle filed I-824 form for her out of status husband, and she
chosen the US consulate in China (on the approval notice for I-824, it was 
signed in GuangZhou by INS). Now she received a letter from the US consulate 
at Guangzhou asking for the following information:
Name, date/place of birth, sex and China address of the family member, 
relation to the principle, and priority date of the principle. 

Now the questions are should the China address or US address be provided? 
Should she tell the consulate that her husband is currently in the US? and  
does she need to file any other forms (say, I-130 or/and I-485) other than 
I-824?

She worried that if she provide the China address, obviously it will delay
the communication; if she give the US address, she is afraid that it will
be some trouble at the final interview.

      My wife is a lad. She filed I-485 in August with F-2 status (I was
   F-1 before filing for PR under CSPA) and her application was accepted.
   However, she got a letter recently from the local INS office requesting
   the evidence that I was in valid F-1 status at the time she filed I-485.
   This is, of cause, impossible (no one as dependent could possibly file
   for PR while the principle is still in valid F-1 status). This letter is
   conrtadictory with the early INS cable (I don't remember the # of the cable)
   which does not consider F-2 to have lost legal status soly becuase the
   principle filed for PR.

      Are the lads with F or J visas still facing the problem of legal status?
   Does anyone have the similar experience? How should I response to the INS's
   request? Any suggestions and references will be greatly appreciated.

	   Please post the following on the net.

	   Dear netters,
		   When more and more LADs are starting their job hunting in the States, 
	   some of them have big problem to convince their potential employers that 
	   they have the work authority.
		   In most interviews, after employers check your professional skill
	   is qualified for the position, the next thing they check is your full time 
	   work authority.  Then, it comes with the big problem!  Because after 
	   filed their I-485, most LADs only got a receipt and a work permit.  On 
	   the receipt, it just says your application is pending. Which means your
	   application can be either approved or rejected.  So the receipt doesn't
	   help you in any way.  On the work permit, it is valid only for one year. 
	   Some employers didn't believe LADs argument: LAD's work permit is 
	   totally different from the work permit for Practical Training, LAD's 
	   work permit is renewable if he could not get GC within this year.  
	   The reason is obvious: You could not expect a technical manager knows 
	   CSPA or Immigration laws as we do.  To a technical manager, what they 
	   care is your qualification and whether it is worth or not to investment 
	   money and time to training you for that specific position.  If you 
	   can legally work only for one year, why should they waste their 
	   money to hire you?  Some small companies don't seriously 
	   inspect your work authority, but to most big companies you have to 
	   show enough evidents to convince them since they have company's 
	   internal regulations.  
		   My concern is our lad-net should direct our LADs brothers 
	   and sisters to find enough official regulations which is in PUBLIC 
	   LIBRARY and can be accessed by companies.  If LADs only download 
	   those regulations form Net, it is not strong enough to convince most 
	   companies.  Any netter knows those regulation's library call numbers, 
	   please post those numbers on Net.  
		   When I saw some of LADs passed the interview but failed at
	   employee authority, I feel really sad.

I agree. It is a real important issue. 
When answer the question as "Are you US permanent resident?"
during the interview, what should an LAD say? It is hard to
explain this complicated point in a minite. If there is a strong
legal document can convince personel/technical recruiters that
LAD's work permit is no different than Green Card, it will be
VERY VERY HELPFUL!

	As an LAD I feel that at this point of time, it is necessary for
us to make a list to show which of the INS's all over the country have 
interviewed or at least have shown evidence of processing LAD's applications
I am under the Kansas City INS but as far as I know that there has not been 
a single person who has even been informed by KC INS for anything, yet. While
some other INS's have started interviewing, I can hardly stop thinking that
there is some thing wrong with KC INS. Therefore, I think a list of this kind
may help people to be more aware of the current situations, and work together
on some problems, if necessary. For example, KC INS keeps saying that they
are so busy and there are simply so many people. BUT, they never are willing
to explain anything in more details. I believe a push from more people or even
an organization such as our LAD or IFCSS will make them talk more. Thanks for
posting my opinion.

I support Phill's suggestion. Why some local INS have processed LAD's
application and some LAD have received final Green Card while some other
local INS did say anything to LADs. We should find out the reason.
Omaha INS haven't done anything to LAD's application as far as I known.

Hi there!

I STRONGLY support this idea.

I believe all LADs filing with Kansas City INS have NOT got anything from KC
INS.

I wrote three letters to KC INS but got no response at all. I also called KC
INS more than four times since the file was sent to them.  The officer simply
told me that they did not know how to process the LADs' applications yet,/ I
should write again,/they were waiting for INS HQ's further instruction,/...
..  As I know, some other LADs did the same thing as I did, none of them
received anything positive from KC INS.

When the LADs sent files to KC INS, they were told that the KC INS would
schedule an interview for the applicants within 120 days. Now over 140 days
passed, no LAD in Kansas state area got anything from them.

We have tried all we could do and tried hard.  Should we simply wait here?

Any comments will be appreciated.

Hi!
Newark INS has been conducting interview for lads who files their I-485 with the
distric office since the beginning of the November.
I went there with my wife and my son(they are LADs) for the interview. The examiner( a lady) first  asked them to sign their name and took thir finger print on I-89. Then she looked at their passports and my employment letter. The interview
went on  smoothly. The whole process took less than 15 minutes. She told us that she will  approve their application when their visa numbers become available. We were given a phone number and told to start calling this number a month later to
check if their visa numbers are available, once the numbers are available, bring their passport to Newark to have it stamped(approval).

Although the examiner who interviewed us is  friendly, some officers there are not the same. Some applicants had bad experience there.

I very concern about the issue of S.618, because my daughter was denied to have
an non-immigrant visa by American consul in Beijing, China. We will be separated
each other two and half years maybe longer than that. She is only 8 years old.
She has to live with her parents, so please pass my strong support for this legislation

	Change your first name in U.S. is a very complicated procedure,
you have to go to court to file a application, and spend several 
hundreds of dollars. (Change your last name is easier: whenever a
girl get married, her last name will automatically change to her 
husband's)   Usually, in this case, people will simply get a middle
name.

Hi, there.  Has everyone who got PR approved gotten his plastic card from INS?
I got my approval notice on Oct. 1.  But I have not receive the plastic card 
yet.   In addition, I have been told by INS (Northern Center) that my 
application (I-824) for my son who is still in China has been approved and
the corresponding documents (cable) were send to GuangZhou on Nov. 2.  However, I have not heard anything since then.  I just wondered that if someone has 
similar experience like me?  What should I do to get things moving? Any comments would be appreciated.

Hi, guys! Last week a fire broke out in the mainbuilding so the computers
were shutdown indefinetely. 

I missed several days of communication with the outside world. I am now
using a temporary account.

Mi Mi Jr. now goes to a talented and gifted program near her new home. She
is regaining her English very fast.

Many parents asked how to arrange a talented and gifted program for their
kids. The basic things are, everyone can do it. If your kids are doing 
escellent in the school, their teacher may recommend them to go for a better
program. If you believe your kids are excellent, you can send them, too. The
most important thing to do, is to find out a psychologist, and have your kids
tested for IQ. It does not matter if they can command English or not. If they
do, fine. If not, you can translate for them during the test. I found out
I was a terrible interpretor at the IQ test! Once the psychologist thinks your
kids are talented, he/she will write the schools. Sometime your kids are not
good at IQ test, but teacher's recommendation letter can do the same. So please
ask the teacher to write one.

You guys know what? Most Americans and immigrants families do not pay much
attention to their kids's education, or they are too bussy to make money, or
they think the job belongs to the schools only. At least, as far as I can tell
from my experience in NYC' public schools. So, if you care about your kids'
homework, your kids are talented, according to the American standard! Once 
your kids are having a good start, their can go on for their own. I took 
Mi Mi Jr. to the Board of Education, spoke to the Director of Talented
and Gifted Programs. She outlined the future for Mi Mi Jr. once she tested 
Mi Mi's ability. Take one to two years in public school's talented and gifted
program, because only the public schools take care of non-native speakers; then
go to a private school. It does not matter if we can afford the tuition, she
says, as long as Mi Mi is talented, she can get scholarships anyway.


The mere fact for most of us to stay in this foreign land, is to aim at
our children's future. Do not miss it. With every netter has a family, many
have, or will have kids. Make the most out of America for them!

Dear Netters, Merry Christmas and Happy New year to you all!
  My LAD has not even gotten her working permit yet. Because she is a J-1 LAD
and has not gotten the 2-year waiver. So her application for PR was rejected by
 Northern INS. However,according to the "CSPA wire #6" (E-mail on 12/20/93 "INS
cable on voluntary Departure and/or Employment Authorization of CSPA Family
members") It seems that every LAD should get their working permit no matter
what kind of visa they hold. My LAD's J-1 visa will soon be expired on 2/14/94.
She wants to get the working permit as soon as she can (she is a J-1 scholar,
her J-1 project already finished, she just can work in campus with related her
field job. She has no working permit out of campus and it is too hard for her
to find a job in campus). My questions are: Anyone knows the procedure for
application of voluntary departure and working permit for my LAD's special case
? Can my LAD just apply working permit? or she has to apply both the voluntary
departure and working permit together? What kinds of form should she fill? What
 address should she mail to for the voluntary departure application? Does
 voluntary depature have to go abroad to have interview if they apply PR?
     Does anyone have the similar case? Any comments, suggestions, refrences,

I plan to obtain the 2-year residence waiver to help my 
spouse (LAD) PR application under E.O. 12711.

In filling out I-612 (waiver application), do I have to
submit I-94 cards of ours ?  For reasons (A: extremal
hardship; B:political persecution), which one to pick,
and how to submit evidence ?

I intend to omit this item,
and explain in my letter that this is asked only because
the local INS LAD interviewer asked me to obtain the waiver.

Share of exprience by netter in this regard will be appreciated.

Hi friends,
	I am back. Sorry for the delay. Here are the newest list.
	As I said last time that I send a third letter to Mr Mi Mi for help.
After I got back, I saw his reply in my mail, too. First of all, it has been
good because he agreed to ask related people for new information on LAD
problems. However, it worried me a little bit because, maybe his LAD's are
doing very well or his friend LAD's are all doing well for they are in a lucky
INS, Mr Mi Mi didn't seem worried at all. 
	He says that people only come to the net when they have problems. 
So our survey has "strong bias"----but did he take a look at our list at
 all, on the figures that half-interview:half-no-interview is right what 
we collected? Besides, the INS's in the list almost cover the country's
 big INS's. I don't agree with Mr Mi Mi's saying that our list is biased 
at all. 
	And he says "unless INS steps in", it is hard to know any new 
information. And I think that is nonsence. Our problem now is that many INS's
have been unfriendly on explaining to people the problems. What Mr Mi Mi said 
is equal to saying that unless the criminals want to become good citizens,
 we can't do anything about them. It seems to me that he don't see the 
problem at all. I wonder if he had read my letter thoroughly, not along the
list. I wish he could help, though. And I don't think I could push him for
more. 
	Agian, I want to state it, that what we LAD's need now is a clear
answer to the questions that when should we be interviewed if any, and why some
INS's have interviewed and some haven't, and does it affect people's priority
dates. And I want to say it again that WE AS LAD'S DESERVE THE ANSWER!!! May
God be with us. Thanks for your support.

Dear friends, 
I would appreciate very much if any of you can give me information on 
the following situation.  I was originally holding H1 and my wife H4.
I got my PR approved recently through CSPA and my wife is a LAD.  Due
to some misinformation and confusions, my wife did not apply adjustment
of status previously and I just find out through local INS today that she 
is in illegal status.  Since my priority day is July 2, they did not
allow her to apply as a LAD now.  Is there anyway to adjust her status
to a legal one?  She is a student and actually have registered for the comming
 semester.
Any comments would be appreciated.  Thanks in advance,

Yeung, there are tons of immigration lawyers in Chicago, you can simply go to
any public library, check the directory Martindale-Hubbell yourself, then
you can pick up whichever you like.

Most of the time, lawyers can't help you anything, they only fill the forms
for you, which you can do it yourself.  Another fact is, good lawyer never
do immigration.  Here are some names and numbers you can try to contact:

There are a bunch of immigration books you can read through. I
have posted some tittles, and anyone can ftp them from our lads-l ftp site,
spike. You can also check your local public libraries to get some. Lawyers
just fill out forms for you, they can not change the fact that you are 
eligible or not. To these days, filing CSPA are getting cheaper and cheaper
in NYC, because a true CSPAer can file more effective than lawyers do. Again,
if you hire them, you got to do everything by yourself. What a lawyer does IS
PROOF READING your forms, which, I have heard from several of my friends, and,
I do not think is worth of your money. If you really want to get help, call
Dr. Zhao's NCCA. They know much better than anyone else in this country.

Hi friends,

	Since the first mail to this net after I got back. I received 
several letters speaking agiast my opinion. I was told to keep them 
confidential, but I want say something on the net for your reference.

	First of all, I agree with the reminding that we are not
here to fight with each other. We'd had too much back home. But second, I still
don't agree with the saying that that what we deserve to know is something
we cannot do anything about, now. Maybe it is right that the INS's are 
really caring about us: look at the YES's under W.P. and INTERVIEW, 
and even some pinky YES's under APPROVAL. But isn't all this what 
we worked very hard for just not too long ago(not fighting with our 
fellow Chinese, but people who don't like the CPSA law)?
 
	I agree very much that this net isn't a Political Org. of any sort. 
Nobody has to do anything whatsoever for the waiting and worrying LAD's. But I
wanted to because I care about LAD's as an LAD. Just do what I can do for us. 

	But no matter how well things are going, and no matter who want to help
and who doesn't, I believe there are people like me who just wanted an answer
and that is why so many people replied my mail, provided information. Again, 
we should never fight each other becasue we are having such a strong 
common interest to work together for. Thanks for all of you who cares. 
I like the spirit because we don't just wait.

			to wait for 60 day FBI check...I think most LAD's 
			here have been intrvw'd..."

			wait for quota. He gave a phone number for quota..."

New Orleans INS		"...turned out that the lady who is in charge of f.p.
			is having a surgery, but no substitution for her..."

Dear Mi Mi Sr:

	recently I received a I-797 from the Eastern Center about
the I-824 approval. The problem is the consulate notified is Beijing instead
of Guangzhou. Does the Beijing Embassy transfer the file to Guangzhou?
Or I have to file I-824 again?

	Any comment is welcome!
