Dear Netters:

   My wife is a lad. I have filed I130S for F21 class and got
approved. However, when we went to the local (Philadelphia) INS
office, we were told that it should not have been approved. The
reason they gave was that there is no visa number for the F21
for people from PRC. I wonder if anyone on the network has gotten
their I130S (family reunion) approved and if so, what is the
next step. Thanks.

Hi Friends,
I filed the I-824 form for my daughter last December, she is in Beijing, China.
The application got approved on January 28, 1994. The approval notice is very simple.
It just said 'we have notified the consulate listed above (GUANGZHOU) that the
applicant's status has been ajusted to that lawful permanent resident. It didn't
tell me what I should do and what my family should do, because my daughter is to 
young, she can not go to GUANGZHOU herself, on the other hand, does that notice
mean my daughter can come to America immediatly or she still has to wait for
some kind of visa number to be available. Any friend would give me further explanation,
I will appreciate.

After reading your letter, I suddenly recall a case of my friend of same 
situation as your wife. My friend got a peice of stammped empty letter,
god knows where it came from, then write the unite in china 








agree to change
the status, then send it to chinese consulate in USA. Couple of days before
they received replay from the consulate, said their application has been 
approved and transfer to the US immigration. Things are such simple.
Would you like to try it?

Following is the most updated information from FEI@BNLDAG.AGS.BNL.GOV,
on the recent progress on S618 AND HR3182. As we all know it, this new
legislation will benefit all the dependents in China, and bring them here
with their loved ones. A long family separation is definitedly nothing 
appealling to anyone. So please support this legislation to pass the Congress.

My reasons to call upon your support are the following. 

1) Some of you have dependents in China, so do it to help yourselves,

2) Some of you may not have now, but probably will have, in future. You 
may want to marry someone in China, and bring her/him here ASAP, so, 
please be prepared to have this legislation handy when you need it,

3) Some of you MAY NEVER have your immediate dependents back in China,
but you probably WILL help someone to immigrate into this country. Your
parents, sisters and brothers. So, please make it handy for them.

All in all, we are all from one background. Early comers, new comers,
whenever you came, wherever you came, we share too much in common.

   More than 50 people from more than 25 states have responded to my message to
support legislations s.618 (introduced by Senator Riegle D-MI) and
HR3182 (by Rep. Frank Pallone, Jr. D-NJ). 
Enclosed please find the text of the bill HR3182 and Pallone's statement.
Note that the text of HR3182 I just got is identical to the bill S.618.

   I spoke to staff members of Riegle and Pallone. They hope to pass the bill 
this year, or attach it to a bigger bill then pass it.
   I also have messages from Senator Simon's office:
1. Maybe to try this program for one or two years if there is no strong support.
Later try to make it a permanent law. Of course, it would be the best for us
to have it permanent as soon as possible.
2. Though Kennedy is a cosponsor, we still need to ask his active support.
Indeed his staff member has the most pessimistic view even though that member
could not identify anyone against the bill. 
 
We must support our friends in Congress. Here are things we can do to help
(1) Spread the relevant information to more people. We now have volunteers 
distribute my message to other networks. I would like to thank Krzysztof for 
making suggestions on sample letters and many others for important suggestions.
(2) Write/call members of Judiciary Committee in Congress.
(3) Ask U.S. Senators and representatives in your state to co-sponsor the 
legislation. HR3182 has 19 cosponsors now. You may attach Pallone's statement
with your letters. 

We are all full time students and professionals and we are very busy indeed, 
please do whatever we can to help this effort. 
To push a legislation is not an instant act but a patient work.

STATEMENT ON THE SPOUSAL AND CHILDREN IMMIGRATION ACT
		REP. FRANK PALLONE, JR. (D-N.J.)

   Following the August Congressional District Work Period, I will be 
introducing legislation that would permit the admission to the United States 
of nonimmigrant visitors who are the spouses and children of permanent 
resident aliens residing and working in this country.

   This legislation is intended to fill a void in our current immigration 
policy that has resulted in permanent resident aliens---people who have come 
into this country legally and who are gainfully employed---being separated
from their spouses and children, often for periods of several years. The bill
would simply make it easier for family members to come to the United States
on a temporary basis, with provisions to penalize those who overstay their
visas. Its goal is to alleviate the human hardship of prolonged family 
separation. Similar legislation has already been introduced in the Senate
by Senator Riegle of Michigan.

   The legislation would eliminate the implication that the existence of a
petition for permanent residence implies that an applicant will not return
to his or her home nation and would remain in the United States after the 
expiration of a temporary visa. This equitable solution simply grants to 
immigrant family members the same opportunity to visit the United States 
as all others desiring to come here as visitors or students. The legislation
anticipates the possibility that some may violate the terms of their 
visas by overstaying the period for which the visa provides. It penalizes
spouses or children of permanent resident who overstay their visas by allowing
the Secretary of State to delay their permanent visa petitions for one year
if visa durations are violated. 

   I am hoping that this proposal will receive strong support from the Members
of the Caucus on India and Indian-Americans, and other Members of Congress
who agree with the need to address this inequity. The issue of spousal and 
child reunification has been identified as one of the top domestic priorities
of the Asian-Indian community in the United States. With the Caucus members
working together, enactment of this bill would be an opportunity for
the Caucus to make its presence felt in a substantive way. Furthermore,
this proposal has already received significant support from some of
America's major corporations, particularly in the information and communications
sectors, who recognize the importance of allowing their valued employees to
have greater contact with their families. The bill is, by its very nature, an 
interim measure. In order to allay some of the misunderstandings that will
arise, it should be pointed out that the legislation will not result in an
increase in the numbers of immigrants admitted annually, it will not have
an impact on the labor market, and it will not have any adverse effects on 
any government social programs, since the spouses would not be entitled to 
these benefits. It is a very modest proposal intended only to bring some 
relief to families separated by unfortunate administrative delays.

   To amend the Immigration and Nationality Act to permit the admission
to the United States of nonimmigrant students and visitors who are 
the spouses and children of United States permanent resident aliens,
and for other purposes.
   Be it enacted by the Senate and House of Representatives of the 
United States of America in Congress assembled,

SECTION 1. ADMISSION OF CERTAIN "B" AND "F" VISA NONIMMIGRANTS WHO ARE
SPOUSES OR CHILDREN OF UNITED STATES PERMANENT RESIDENT 
ALIENS.
Section 212 of the Immigration and Nationality Act (8 U.S.C.
1182) is amended by adding at the end thereof the following new
subsection:
(o)(1) Notwithstanding any other provision of law, no alien---
(A) who is the spouse or child of an alien lawfully admitted for
    permanent residence to the United States,
(B) who seeks admission to the United States for purposes of 
    visiting the permanent resident spouse or parent or for studying
    in the United States, and
(C) who is otherwise qualified,
may be denied issuance of a visa, or may be denied admission to the 
United States, as a nonimmigrant alien described in section 
101(a)(15)(B) who is coming to the United States temporarily for 
pleasure or as a nonimmigrant alien described in section 101(a)(15)(F).

(2) Whenever an alien described in paragraph (1) seeks 
admission to the United States as a nonimmigrant alien described in 
section 101(a)(15)(B) who is coming temporarily for pleasure or as a
nonimmigrant alien described in section 101(a)(15)(F), the fact that a 
petition has been filed on the alien's behalf for classification of the
alien as an alien lawfully admitted for permanent residence shall not 
constitute evidence of the alien's intention to abandon his or her
foreign residence.

(3) Notwithstanding any other provision of law, any alien-
(A) who is issued a nonimmigrant visa under paragraph (1),
(B) who was admitted to the United States, and
(C) who remains in the United States longer than the period 
authorized for such nonimmigrant status,
shall be ineligible to receive an immigrant visa for a period of up to
one year after the alien's priority date has been reached, as the 
Secretary of State may determine.

Good news for Kansas City area.  KC INS begins to interview lad. Tod    ay I
received a letter form KC INS in which they give me an appointment on March 10.
In the letter they also required me to bring necessary documents and one copy
of them.  Following are the required documents:
(1) All Passports;
(2) I-94;
(3) birth certificate and a translation of the certificate;
(4) Marriage certificate and the translation of the certificate;
(5) Evidence that spouse's application for PR was granted;
(6) The documents that prove that you continuously maintained a lawful status
all periods in the U.S.. (for example ALL I-20's and college transcripts
for F-1 student).
(7) Bring original documents and a PHOTOCOPY of the original.
 
For limit time I have, I will not response any questions.  Just be patient!

We need to construct a caller ID unit, with powered glass input by

ASIC (Application Specific Integrated Circuit) instead of LCD (liquid

crystal display). To our knowledge, ASIC's are being made in Korea

and Japan, but not China:
1) Do you know a source (in the U.S. or in China) of ASIC's?
2) Do you know any company (in the U.S. or in China) that could
manufacture a caller ID unit using ASIC instead of LCD.
3) Can you do the engineering yourself? All you have to do id to
reduce the size of current caller ID unit by 40% or more, and replace
LCD with ASIC (which you may have to design yourself).
4) If you can take care of this entire project, we'll pay NO LESS
than $15 per hour. Bonus for excellent design with no problems. Bonus
for early completion. Also we'll come to you for future projects at
an even higher rate of pay.

ALSO: We're looking in general for highly-competent engineering
students IN ANY FIELD to work on miscellaneous other projects as they
occur. If you're the best at what you do and are willing to work to

I am a CSPA in Kansas state.  I was approved by INS Lincoln Service Center 
on sept. 22 1993. I got a temporary stamp on my passport.  Since the time
past for certain long time, all my friends in this city got their real card
except mine.  What should I do?  Wait or send a letter to the local INS?
Is that possable to renew the temporary card? 

Has anyone in this area not received you green card either?

Yes. My son, as a LAD, just got his renewal Working Permit from Portland 
INS yesterday. An officer of INS also told him that he need to wait about
six more months to get his Greencard.

Last Aug. my son filed the PR application as LAD with the INS at The Twin
Cities, MN. I have not heard any thing yet. I know my son with many other 
applicants have the quota problem; anyway I contacted the INS.
I was told by two officers that because my son priority date was in Aug.
they have not processed his application. I tried to explain that his
priority date should be my priority date which is July 1, but I failed
to convince them. They insisted that my son's priority date is his
application date.

Do you have any idea about how to clarify this and convince them.
Thank you for any suggestions.

I believe only spouse adopts his/her principle's priority date, Not
general dependents.

Xiao-Liang Xu:

Maybe INS is confused with the categories? For EB-3, the priority date 
is July 1, but for the FB-2, it is the date you filed. Try to show them
the CSPA text, and the right category your son belongs.

I have two questions about a LAD child applying for his PR.

Q1: Does a LAD child have to be under age 21 to be qualify for
    applying his PR through E3 or F2, or both.  If the answer is "yes",
    what will happen if the child gets 21 years old before gets his PR?

Q2: If a LAD child applies his PR under either E3 or F2, or both with
    his mother, can he apply his PR with his father unde E2 through the
    normal procedure later?

What is this date?  The date for CSPA principal processing, or the visa number
current date for LADs (in other words, does this mean for LADs having the July

They are the same, if INS did not issue you thousands of A#s! But INS
do stupid things like issuing several i-94 # and A# to a single person,
and some one has multiple SSN too.

Maybe INS is confused with the categories? For EB-3, the priority date 
is July 1, but for the FB-2, it is the date you filed. Try to show them
the CSPA text, and the right category your son belongs. 

it seems that a LAD does not benefit anything from being a CSPA dependent
when applying through FB-2.  When applying EB-3, he/she gets principle's
priority date (as well as the opportunity to apply, otherwise he/she has
to go through H-1).  While applying through FB-2, he/she gets nothing 
special.  As a dependent of PR, he/she can always apply FB-2 whether his/her
principle is a CSPA or not.

Anybody has comments on this?  Anything is appreciated.

Does anyone know the true difference on the purposes of I-824 and I-130?

The "Who can file?" section of I-130 says:
A citizen or lawful permanent resident of the United States can file this
form to establish the relationship of certain alien relatives (later 
section indicates unmarried child and spouse for PR) who may wish to immigrate 
to the United States.

The "WHo may file" section of I-824 says:
If you filed an application or petition which has been approved, use this
form during the calidity of the approved application or petition to:
	. request a duplicate approval notice
	. request that another consulate be notified of the approval of the
	  petition
	. request that a U.S. Consulate be notified that your status has
	  been adjusted to permanent rsident, so your spouse and children 
	  can apply for immigrant visas.

It seems both are for a dependent to start applying PR.  I wonder if anyone
has any idea on their difference.

   Several netters asked EB-3 or/and FB-2 for lads.

   If the principal applys through EB-3, his/her immidiate dependents, spouse
   and kids under 21 can apply through follow to join, that is same category 
   as the principal's, EB-3. This is stated by the law. There was a confussion 
   among our LC community on this matter, since they thought the dependents are 
   not skilled workers or professionals, how come they can apply through EB-3, 
   thus taking the precious quota from LC?

   If both parents are principals, belong to different categories, say, one
   EB-2 and the other is EB-3, the kids can follow either, or both. 

   When the principal becomes PR, his/her dependents, spouse and kids, can apply
   through FB categories.

   Basically, when you become PR, you can bring your spouse and unmarried
   kids here. When you become citizen, you can apply for your parents, and 
   married kids here. CSPA creates a huge hole for Chinese immigrants. It
   created immitately 50,000 newly minted immigrants, and, in five years,
   Americans. This will speed the Chinese influs very rapidly. Wow!

	According to CND, EB-3 cutoff date did move to July 2 for March.
That means those LADs who haven't applied can apply in March, and those
who applied and were interviewed and passed can go to local INS and
have them stamp passports in March. And I believe the "Pink Cards" are also
on the way. In the meantime, they have to pay REAL tax starting this
year!
	Correct me if I'am wrong.

The new cutoff date of July 2 did not seem to attract enough discussion.  I

Sorry for the previous empty messages. The cutoff date, to my understanding, 
means that you can file I-485, if your principal's priority date is included.
It neither means you will get your PR nor interview NOW. It just kicks off
your filing process. Remeber many of our lads had filed last August and 
September when the cutoff date was "current", but how many have gotten their
interviews and/or their GC?

I even do not think those who filed last year will all get their GC this year.
Just think about how many quotas are out there for China's EB-3? So, please 
be patient, do not jump at the cutoff date too soon!

    I am not sure why they asked this.  But during my wife's LAD interview with
    the Dallas INS, the examiner also asked for her transcript (F-1 visa status
    before).  And also the wierdest thing is they asked for the copy of the
    apt. lease.

    I guess the examiner may be looking for places where they can invalidate a
    LAD's application by the clause of "continuously maintained legal status".
    Therefore for a ex F-1, the first thing they might look is the transcript,
    to see if the LAD had maintained full-time student status before the time
    of the petition.

Dear friends,

I am a LAD with a DED principle,  my husband keeped his F-1 until he graduated,
then, he got the employment authorization card in that month which is May, 1992.
My F-2 has not changed until I filed my application.  The local INS accepted
my I-485 in last Aug.  and I will go to interview next month.  

What going to happen?  Are they going to ask me to go to China to do the final
process?  Do I need fill out all the forms again?  Can I stay here and get
the working permit card renew?  How about the priority date?  I'm so worry
about all of these.

Is anyone has the same situation as mine?  Any suggestion and experinces are
appreciated.

Good news for LADs in Houston area

Any body with priority date of July 1, 1993 should expect GC for his/her LAD
in near future. My wife got her temporary PR on her passport today in Houston
INS. We were told that her real PR is already in manufacturing. However, the 
valid time for her temporary PR is until 21 in August. You could wait for 
several months for the real card. My PR was approved last Sept.(priority date
is July 1) and I have not received my card yet. Anyway, I hope I announced
good news for the people who are interested in LAD issue.

Hi, thanks for your mail.

Everyone one will be happy if all the lads get GC soon. But we still have quota
problem out there. There are 2000/yr for EB-3, and, on this net, we have 1000
netters, which, should far less than the existing lads pool. That is why I do
not think many will get their GC sooner. That was why we fought so tirelessly
last year for the World  Quota.

and prepared to work. As your know, his work permit is not valid after

legal status throughout, his is not a DED case and not a 90-day either. I 
saw a post recently by Dr. Zhao Haiqing. According to him, the regional 
ins centers are supposed to finish processing the cspa principal cases by 
the end of Jan. In this case, and I am sure there are still other 
similiar cases out there, things do not go like that way. If some one has 
the latest information about that, I need your help. For example, is it 
possible to renew the work permit? is it possible to renew the work 
permit in any ins district offices or the only one where he had 
previously stayed? By the way, does somebody know the email address of 
Dr. Zhao Haiqing or the address of NCCA, so that I can contact with 
someone there directly. Thanks a bunch.

Dear friends : 

I got green card under CSPA, but my wife and my daughter arrive
on 10/13/93 with H-4 visa. My priority date is 07/02/93
and the prove date of my application is  10/17/93. 

I go to Dallas INS office to apply permanent resident status for
my wife and my daughter on early January 1994. and the office
said:

1> no visa number is available for me so I cannot apply.
   (my priority date is 07/02/93 and the current priority date 
   at that time was 02/01/93). 
2> Because my application for permanent resident has been proved
   so my wife and daughter is out of status.
   (an immigration file issued in 08/01/93 said CSPA dependent will not
   be treated as out of status if the principle apply under CSPA,
   but did not say what happens after the principle's application
   is proved) 

I consulted a lawyer. She checked with some INS officer and 
said the status of my wife and daughter are not defined. If I want to know
what I can do I should pay her $200 more and she will talk to some INS
officer to find out. She also said I can apply I-130 which means my
wife and daughter have to wait for 2 years and half. I did not continue
to consult that lawyer because I feel she don't know much about CSPA.

Does anybody knows what I can do ?
Is there any new regulation on the status of later arrive dependent from INS after 08/01/93 ?
Can anybody recommed a better lawyer in Dallas area ?

My sister got her GC approved under CSPA in Sept. last year and filed I-824
for her son in China in the same month. She got a notice from INS told her 
that her I-824 was approved and her case was cabled to US Consulate in 
SHANGHAI (she chose Shanghai in the form when she filed). Since then she 
got no word from the consulate. I know every one get notice from GUANGZHOU 
instead SHANGHAI. If any person out there or you know any one has the same 
situation as my sister has, please drop me a message. Thank you in advance.

Dear Madam Feinstein,

The purpose of writing this letter is to bring to your kind attention
the family reunification aspect of the permanent residents of the
United states.

The current immigration law allows the US permanent resident's
spouse to immigrate to the US after a long wait - typically
three years for most asian countries. For some countries the wait
is even more. The reason for the wait, I am told, is the enormous
backlog, and a lot of paperwork involved therein. I am confident that
you understand that this wait is unfair, undemocratic, cruel, and
extremely stressful to the couple, both physically and mentally.

I am an engineering professional who has contributed to both the wealth
and the technology of the country - by way of paying state and federal
taxes, and developing state-of-the-art technology, which has proven beneficial
to both, commercial US businesses and the defense industry. There are many
thousands of similar professionals and students in this country who
have contributed profusely in virtually all the aspects of professional and
academic realm, thereby helping USA evolve as a powerful economy and a
great nation. Unfortunately, a good number of them have to inevitably go
through the aforementioned family hardship at one time or the other.
I have personally known families who had to suffer dire consequences
as a result of the stress and trauma they were subjected to.

The legislation from the Senate (legislation S. 618), and more recently
the House of Representatives(legislation H.R. 3182) is the solution to the
problem, which I understand are in the Judiciary Committees. The congress
gets to vote on it once it gets cleared from the Judiciary Committees.
In all modesty, and humbleness, I along with so many thousands
of professionals and students would like to urge you to vote on these bills
favorably.  The sooner the legislation gets implemented the earlier
our family related problems get resolved, thereby making it feasible to plan
our family life.

INS office which asked my wife if her spouse was in 
continuous in keeping F-1 upon the day she filed for 
her adjustment of the status, Of course I didn't take
full-time courses after I got first degree unti the
date she filed her I-485.

Just tell the truth. If you have kept legistmate status up to YOUR filing
I-485, then should not you have any trouble if you were F-1 student. In CSPA
case, you may keep your  legistmate status up to your principal's filing 
CSPA.
