Dear friends:

	We have some problems related to LAD I-485 application. If someone had
same experients, please give us an reply! We need your help. Any suggestions
will be highly appreciated!

	I am a LAD in Tennessee. I came the united state on Oct. 1990 with a 
F-2 visa. I have filed an application form I-485 with all the relevant 
materials for PR at Sept. 1993.  Seven month after I filed those materials, 
in April this year I received the first letter from INS office that asked me 
to submit all the transcripts for every semesters my husband had enrolled in 
the Univ. We sent all the requied materials to INS office next week after we 
received the letter.

	 Today I received second letter from INS office which is titled as
"NOTICE OF INTENT TO DENY". The letter said,"The graduate school at your Univ.
considers a student to be taking a full course of study if the student is 
enrolled for a minimum of nine semester hours each semester. The transcripts 
you submitted reflect that your spouse was enrolled for only six semester 
hours during the spring of 1992. Therefore according to the evidence submitted
, it appears that your spouse violated his F-1 nonimmigrant status by not
attending school on a full-time basis and as a result, it appears that you 
also failed to maitain your nonimmigrant status since your status was 
dependent upon your husband's status."  Then it notices that "In the event that
you have evidence or an explanation to establish that you did maintain your 
status during the period mentioned previously, please submit all of the 
relevant material to this office with in THIRTY days of the date of this 
letter." 

	We don't know what kind of explanation will be accepted by INS office.
If someone have any ideals or experients about that, please drop us a 
information. Advenced appreciation to any suggestions from you!

If your husband's foreign student advisor, or graduate advisor can sign a
letter, telling the INS that the six credit/semester event was due to some
legitimate reasons, then INS should be satisfied. Among those reasons, there
are:

1) Health Problem: due to certain health condition, a full time study was 
   difficult to maintain, and he might want to take a part time instead;
2) Academic Reasons: Since it was several years into his program, there might
   not be enough courses for him to take, say, all the other courses offered at
   that time were either the ones he had taken before, or in the fields not
   related to his intented study. That was, he intended to take nine credits
   but due to the courses offered, he was not able to do so. In this event,
   he even did not have to take any course in order to maintain his full time
   status (of course he had to register). Talk to his academic advisor for 
   this event, and it is not difficult to ask him to sign a letter and then
   ask the the foreign student advisor to sign it also.

Do not panic. You are quite okay!

has changed his status to DED (Bush excutive order), then you don't need to
worrry. Just explain it to INS. Otherwise, you should think of a good reason,
such as illness.

worse, since she has no chance to change it. If he is officially DED, then she
is a DED lad, to be diapproved inside U.S. 

INS is trying to find out he was ACTUALLY DED at that time, how could you help
INS to make sure he was actually DED if he did not apply for one officially?

The best way for her is, ask his academic advisor to write a letter since there
were not enough courses available at that time, he was authorized by the 
advisor to take just 6 credits. THIS IS THE MOST EFFECTIVE AND REALISTIC
SOLUTION.

We lads-l committee had too many DED lads cases to deal with. You have to
avoid being marked as DED lads in the first place. Otherwise, you are making
trouble for yourselvs.

   worrry. Just explain it to INS. Otherwise, you should think of a good reason,
   such as illness.

PL 103-123 is almost identical with 102-141, which I posted earlier (A
html version can be found at

Also, all the public laws and other federal legal documents can be
found at Library of Congress online catalog.  You can use telnet to
access it:

	telnet locis.loc.gov

Once you are connected, pick 2 for federal legal information.  You can
use keyword search, subject search, etc.  The fulltext of most public
laws are available.

I am still not clear whether one can use 102-141 or 103-123 to
convince a federal organization to hire you.

Hello, dear friends:

	Since I send a e-mail "Asking help on LAD problem" last night, I have
received many reply e-mails. We greatly appreciate your help. I didn't expect
much about the reply When I sent that letter out lastnight. The LADnet really
help us very much. Thank you so much, every friends at LADnet!

	The reason my husband took only 6 credit hours is the regulation at 
graduate school bulletin said,"Since graduate assistants are expected to make 
normal prograss toward a degree, a minimum credit load of 6 hours per semester
is required. Any exception to this regulation must be approved by the Dean of 
the graduate school."  He was a full-time graduate teaching assistant during
that period. He and his advisor didn't know that there are another police for 
nonimmigrant F-1 student (  According to our school international student 
advisor, School omitted this part at graduate school bulletin for some reason 
but INS office do have this police on their table.). 

	We have talked to school international student advisor this afternoon.
She said she will help us to solve this problem and try to talk to Immigration 
officer about this event next Tus. And we will also send my husband's contract
copy during that period and a letter from his Dept. which states he was a 
full-time graduate teaching assistant at that time. We hope that everything 
will be fine. Otherwise, we have to apply PR again and my child and I have to 
leave this country also.

Hi friends:
	I am a new netter of LADS-L. I have some questions about lad. My wife, who came to USA on /9/05/1990, filed I-485 on the morning of /8/02/93 to the INS New York Office. We went over there and dropped the whole application pakage in a mail box in the reception room. 
	Since then, we have not recieved any reply from INS. However,from the back side of $120 cashed check we realized that they processed or opened her application pachage on 8/03/93 and cashed the check on 8/04/93.  
 	My wife, who was graduate student with F-1 visa then, graduated on May 26. She had to file Practical Trainning 1 1/2 months ago for maintaining a lawful statue, even though she had filed I-485, but she didn't recieve any notice from INS.
	The reason why she file I-765 for practical training is that we have nothing except a cashed check to verify that she is in pending state so that she can apply work permit based on her petition, meanwhile maintainning a lawful statue.
	Up to now, I have heard nothing from INS for both I-485 (permanant residency) and I-765 (practical tranning, check was also cashed). I don't know what I should do next?

	I am sorry to use this net for CSPA problem. I really don't know if there is right net, which is alive, I should use.

	Anyway, I recieved my GC finally, but with misprinted date of birth. they printed 09/**/**/ instead of 04/**/****. Since I am pretty sure I provided right DOB to them. I sent two letters to INS CARD FACILITY, and INS EASTERN SERVICE CENTER respectively two months ago. However up to now I have not recieved anything from either of them.

	Anyone has any experience on it? any suggestion will be highly appreciated.

First, go INS office to ask your wife's status, bring your canceled check,
it contains all information. (My laywer told me it when my receipt was missing
on mail) They processing LAD again this month, one of my friend just got
her passport stamped on July first.

It is better to file application in person, they need check your file, give
you a A number, AND hold your I-94, after that, you can get working permit.
I don't know you hand in your wife's I-94 or not, if not, did you give them 
a copy? Did your wife left US(even go to Canada) after filing? you will have
some trouble if you did not give them a copy of I-94 or go outside US because
your wife's status had already changed to immigration pending after you file
application.

INS usually not give anything out when I-485 is file at local office, they 
assume you file in person.

Good luck to catch visa number on July, local officer of INS is not sure
how many can be issued this month. They are not issue a lot interview.

I would like to apply for extent employment authrization. I submitted   
aplication form I-485 and all related file regarding to PR on Aug. 3,1993.  
Now the PR application is pending. I didn't hear anything from INS of New   
York City. I got employment authorization card in Sept. 1993. This card is  
valid only for one year. Now I need to apply for extent the card. Does  
anybody know how to apply for? My local INS is New York City. I would like  
to know where to apply for the application, 26 Federal Palaza or Mid-town of
Mahattan? How long in advance should I apply for the application? I tried to
call local INS. Because of automatic phone system, I can't talk to INS  
officer directly.   
If you have any experices, please share with me. Your help will be really

I was told by INS officer that if there were any mistake appearing on the
GC, one could go to the LOCAL INS to reprocess it.  That means you have to
take photos and do the signature and finger print (for the card) again, and
wait for the new GC for another several months.  I assume that it is free
of charge, except for the photos. It sounds disappointing, but I think
perhaps there is no better way.
Anyway, this should be a minor problem to be corrected.  So take it easy.

Hi, 

	I got a question about Medical Exam for LADS. My wife is an LAD
and her application was sent in last August. She got a letter from 
local INS office for interview. (the interview is scheduled on 7/20/94). 
In the letter, she is asked to bring a medical exam. Actually, we 
included a medical exam when we sent application last August 
(the medical exam was done on 6/20/93). I heard that the medical exam 
is valid for one year. My question here is that how the INS counts the
one year, from the time of the exam to the time of interview or application? 
In other words, do we need a new medical exam? Does anybody get the similar 
situation? Any information about this is welcome. Thanks!

	My wife and son have got interviewed on 6/7/93.  New medical exam
was not required, although it was listed in the attachment of the letter
(with many many other things, such as proof of living together with the
principal, which actually were not checked by the interviewer either). 
Actually, the interviewer did not mention the medical exam at all.  My
understanding is that being listed does not necessarily mean being
required (since the list is an universal format), unless you have not
submitted it before, or it is specified in the letter.
	My suggestion is, if new exam is not specified (or not with a check
mark) in the letter, don't go for another exam before the interview,  but
just get prepared for that.  Even it will be required, it will not be
too late to take the exam after the interview.
	I did complete another Affidavit of Support for the interview (it
costs much less than a new medical exam.), since I thought the old one
might not be valid after nearly one year (during that time I changed my
position also).  But the interviewer didn't ask for it either.

Unless otherwise specified during the current fiscal year no part of any
appropriation contained in this or any other Act shall be used to pay the
compensation of any officer or employee of the Government t of the United
States (including any agency the majority of the stock of which is owned by
the Government of the United States) whose post of duty is in the continental
United States unless such person

	o (1) is a citizen of the United States,

	o (2) is a person in the service of the United States on the date of
	  enactment of this Act, who, being eligible for citizenship has filed
	  a declaration of intention to become a citizen of the United States
	  prior to such date and is actually residing in the United States,

	o (3) is a person who owes allegiance to the United States,

	o (4) is an alien from Cuba Poland, South Vietnam, or the Baltic
	  countries lawfully admitted to the United States for permanent
	  residence, or

	o (5) South Vietnamese, Cambodian, and Laotian refugees paroled in the
	  United States after January l, 1975, or

	o (6) nationals of the People's Republic of China protected by
	  Executive Order Number 12711 of April 11, l99O: *Provided*, That for
	  the purpose of this section, an affidavit signed by any such person
	  shall be considered prima facie evidence that the requirements of
	  this section with respect to his or her status have been complied
	  with: *Provided* further, That any person making a false affidavit
	  shall be guilty of a felony, and, upon conviction, shall be fined no
	  more than $4,000 or imprisoned for not more than one year.  or both:
	  *Provided* further, That the above penal clause shall be in addition
	  to, and not in substitution for any other provisions of existing law

Dear friends:

	We have post two letters in this LADnet related to the problems about
LAD we met. In the second letter we thought the international student advisor
will help us to solve the problem and every thing will be fine. Unfortunately 
she just suggests us to hire a immigration lawer to help us. She couldn't give 
us any evidences or explanations for INS office since she is the person who is 
supposed to request international student taking 9 credit hours each semester.
After she talk to my husband's advisor, we don't think we can expect any thing
from his advisor, also. 

	Now the only thing we can do is explanating that the decision of took
6 credit hours at that semester my husband and his advisor made was based on 
the buletin of graduate school and policy of graduate assistantships (we will 
attech those documents to INS ) and they didn't know there are another 
regulation for international student untill we received this letter. 

	But we are quite doubt that INS officer will except this explanation. 
We heard that two international students in our school have received deny of
practise training program because of their taking less than 9 credit hours at
one of the semester. That is really bad news to us. We don't know what we can 
do next if INS officer denies our application. Are we out of status LADS? I 
had changed my F-2 status to F-1 status at summer 1992. My daught applied PR 
on the basis of being my dependents. So if I am denied and she will be denied,
also.      

      	If the worst case happens, Should we leave the United States and 
reenter it again? (According to the letter. I had been out of status if we
recongnize that my husband was out of status no matter what status I am now).
Can we reenter from any third coutry or we have to go back to China.( Since I 
have signed new contract for the fall semester, it will be the last semester 
for my master's degree, I think I can get F-1 visa again myself without any 
problem. But what is going to happen to my dought's F-2 visa?) Can we still 
apply for LADS or I have to go the regular way starting at my prectise 
training program? 
  
	Is there another application form we can file for LADS except I-485 
form (Is it for family-based?) Is there a ftp site for information of out of
status LADS? Does someone know if there are some good immigration lawers who
know more about CSPA LADS case around Tennessee area or south area?   

	If someone can help us or tell us any experiences about that, please
give us a mail. Any help will be highly appreciated!!

Ladies and Gentleman:
 
    May 19, 1994, CBS Evening News, "Eye on America".  A group of Chinese 
faces, men, women and children, flooded out from an airport terminal.  "Only 
U.S. citizens continue straight ahead", an airport official said, directing 
these Chinese faces turn to the immigration gate.

   Now the reporter Connie's face, showing grave concern for America, 
"Everyday, planeloads of Chinese citizens arrive legally in the United States, 
ordinary people",  she started to explain that among  these ordinary Chinese 
faces, men, women and children, "some of them may be future spies, who, a few 
years down the road, will be activated to steal American's military and 
technological secrets"!

   That is one plane.  There are "planeloads", "everyday", spies!

   This program enraged the entire Chinese community.  No matter what their 
background is,  one thing is clear, this subjective, distorted and 
unprofessionally produced program has threatened everybody who looks like a 
Chinese.  They could be spies!  They don't have to be caught or convicted to 
be spies!  They are "future" spies!

   Thousands of protest letters have been received by the CBS, but CBS vice 
president, a Mr. Lane Venardos, shows no regret or sympathy.  In his identical 
replies to many protesters, particularly a letter to Mr. Shi Heping, the Vice 
President of IFCSS, a Chinese student and scholars association, Mr. Venardos 
lectured: "Our job is to bring all stories to the attention of the public, 
even those that may make some viewers uncomfortable, That is the very 
definition of a free press"! 

    Some story!  Obviously, to Mr. Venardos, the flat faced Chinese as shown 
in the program do not understand what freedom of press is! He contends that he 
can make any slanderous remarks, and that is the "very definition of a free 
press"!

    Attached please find a reply from the national coordinator of the CBS 
Incident Committee, which contains more detailed information about this racist 
and slanderous CBS report.  Also attached are the transcript of the original 
CBS Evening News program, Mr. Shi's original protest letter and Mr. Venardos'

Dear Vice President Lane Venardos:

Your recent letter to the Vice President of the Independent Federation 
of Chinese Students and Scholars, Mr. Shi, has been brought to my 
attention, in my capacity as the National Coordinator of the CBS 
Incident Committee, a nationwide assembly of Chinese students and 
scholars who have joined to protest the CBS Evening News' May 19th 
broadcast regarding a presumed threat of ordinary Chinese nationals 
spying for China in the United States. Our committee consists of 60 core 
members, regional and local coordinators, and a pool of over a thousand 
volunteers nationwide, coordinating activities provoked by this 
unfortunate incident.

We appreciate your thoughtful and immediate response to Mr. Shi and 
other complainants. Yet, we find that the reply is far from 
satisfactory, fallacies were abound, questions were unanswered. We would 
like to take this opportunity to express our grave concerns in more 
detail. We expect your kind response point by point.

A.    In the CBS broadcast and in the subsequent transcript which we 
received, it was mentioned that the major interviewee in the report, Mr. 
Nicholas Eftimiades, was an employee of the Defense Information Agency. 
Your reply to Mr. Shi also states that your information came from "the 
United States Defense Information Agency in Washington". 

There is no "Defense Information Agency" anywhere in the United States. 
Mr. Nicholas Eftimiades is employed by the Defense Intelligence Agency. 
While this is a very small and subtle error, if CBS "special 
investigators" had read Mr. Nicholas Eftimiades' book, or had 
communicated with the Defense Intelligence Agency, they would have 
realized the mistake. This oversight not only characterizes the 
unprofessional nature of this program, but also highlights the fact that 
mistakes were definitely made in this broadcast. Now, the real questions 
are, how many more mistakes were made, and to what extent harm has been 
done to innocent people in this country!

B.    The May 19th broadcasting opened with the statement that, "Every 
day, planeloads of Chinese citizens arrive legally in the United States, 
ordinary people. But to the Chinese government, some of them may be 
future spies, who, a few years down the road, will be activated to steal 
America's military and technological secrets... ". Three aspects of this 
statement need to be addressed: 

1)    In reference to the "planeloads of Chinese citizens" who are 
allegedly recruited as agents, your report stated the following: "A 
Chinese student or scientist or businessperson applies for a visa to go 
to the US. Then the Ministry of State Security (MSS) starts asking 
questions: What can you learn in the States? Will you be working with 
computers? Will you be loyal to China? And most importantly, can you be 
patient?" This is apparently meant to illustrate the standard and 
routine process for recruiting an agent. In reality, according to your 
interviewee himself, Mr. Eftimiades, MSS is very picky and cautious in 
recruiting. On page 64 of Mr. Eftimiades' book, he details how a certain 
individual was recruited: 

     "MSS made use of its resources in identifying this individual and 
     assessing his ability to conduct espionage. The recruitment process
     took place over six months. The time invested, as well as the
     ministry's foreknowledge of the source's personality and apparent
     prospects for academic achievement, indicates a well-planned and
     carefully regulated process of development and recruitment."

In your broadcast, all those procedures and precautions disappeared. 
Each and every ordinary Chinese is simply approached with a blatant 
request to be recruited as agent, according to your reporter. I can 
summon thousands, if not tens of thousands, of "ordinary" Chinese to 
testify before any grand jury that your spy recruiting story is simply 
fake.

It is not too hard to find the discrepancies between your report and the 
book. Your report generalized and distorted the facts obtained from the 
U.S. intelligence, putting words into the interviewee's mouth and 
pointing fingers at us, the "ordinary people", as we are referred to in 
your report.

2)    The report also alleged that those "ordinary" Chinese are sent by 
the Chinese intelligence as "sleeper spies", "fish in the bottom of the 
ocean" waiting to be surfaced in the "future".

However, as the report stated, the development of "sleeper" agents 
usually require a long preparation period, yet that is not possible with 
most Chinese nationals entering the United States. According to American 
Government documents, the majority of students and scholars who have 
arrived in the U.S. since 1978 (when diplomatic relations between the 
U.S. and China were normalized) have been exchange visitors on J-1 
visas. A J-1 visa holder must return to his or her home country after 
completing research and study programs. This is generally three or four 
years for a scholar and the reasonable length for a student to complete 
an advanced degree. It was not until after the Tiananmen pro-democracy 
movement that President Bush waived this requirement for some of the 
Chinese exchange visitors who were in the U.S. at the time. Thus, there 
was no way for these alleged "fish", as they are ridiculed in your 
report, even to think about surfacing 20-30 years in the future as your 
report suggested.

There is no evidence at all to support the "future" spy allegations in 
your report, which are the most disturbing and outrageous part. Those 
claims establish that even if a Chinese does not get caught spying, he 
or she is still a spy suspect! He or she is a spy suspect for life! CBS, 
as a news organization, cannot blame the US intelligence agencies for 
this irresponsible claim. The US intelligence agencies can suspect and 
investigate any Chinese or non-Chinese in the US, however "ordinary", if 
there is sufficient evidence to do so, but they do not make a public 
announcement that any "ordinary" Chinese is suspected of being a 
"future" spy. What CBS has done is clearly slanderous!

3)    In reference to your "concrete example" of an "ordinary" Chinese 
who was chosen to become a "sleeper" agent, Mr. Kao is hardly ordinary. 
Mr. Kao arrived in the United States in 1971, seven years before formal 
Sino-U.S. diplomatic relations were established. In 1971, there was no 
way for any ordinary Chinese to get visa to the U.S., no transportation 
from China to the U.S. and certainly there were no "planeloads" of 
"ordinary" Chinese as shown in the opening of the report. Mr. Kao is not 
one of the alleged "ordinary" "Chinese student, scientist or 
businessman" whose dramatic spying journey "all starts here in 
Beijing..."! 

C.    In the May 19 broadcast, an interview was staged to dramatize the 
issue. The interview went as follows:

  "Unidentified Man #1: Never forget, you belong to our organization.
  "CHUNG: Never forget,' they told him, 'you belong to our rganization.
  "Man #1: You were sent by our organization.
  "CHUNG: You were sent by our organization, and this organization 
          belongs to the Communist Party.
  "Man #1: ...Communist Party.

If we were actually to believe that this was a conversation between a 
"sleeper" spy and an MSS case officer, we would like to pose the 
following questions:

1)    Wouldn't this conversation be in Chinese, rather than in English?

2)    Who is this unidentified man, what is this unidentified man and 
      what Chinese or American agency does he work for?

3)    Doesn't this sound like a Hollywood interpretation of how a spy 
      ring would be enforced? We regret to inform you, but China is not 
      Hollywood, and business (be it espionage or car manufacturing) is 
      not conducted in the same terse and straight-forward manner as it
      is here.

D.    At the end of the report, the reporter announced that "The FBI is 
trying to help American corporations protect themselves from espionage. 
The Bureau has a program now to brief executives about how their 
companies could become targets." By stating "The Bureau has a program 
now ..", it implies that the FBI has recently created a new program 
against Chinese nationals to deal with the presumed threat of Chinese 
espionage. This is another fabrication alleging the U.S. government 
launching racist programs against the Chinese community! The fact is 
that the FBI has had programs in place for many years to protect 
America's interests from espionage originating from all countries, 
friendly or hostile. The implications arising from this misleading 
statement is overwhelming, possibly leading to a national "witch hunt" 
for Chinese in high-power jobs.

E.    In your reply to Mr. Shi's letter, you mentioned (as further proof 
that this broadcast was legitimate) that between 1986 and 1993 "one in 
eight of all illegal export enforcement cases closed by U.S. Commerce 
Department involved the People's Republic of China...". First of all, 
trade violations and espionage are different concepts. Second, we would 
like to know, what percentage of these "illegal export" crimes are 
committed by businesses that tried to get around trade regulations to 
make money, and which were genuine "spy network" cases? According to our 
investigation, there is only one in thirty of all illegal export cases 
that could be related to espionage involving China. And this percentage 
is comparable to that of cases involving the U.S. allies such as the 
United Kingdom, West Germany and Japan. 

Besides, you cannot use illegal export cases to China to support this 
particular news report, which was targeting "planeloads" of "ordinary" 
Chinese, and which made no mention whatsoever about Americans of 
non Chinese origin. You must know that most of these illegal export 
cases to China involve Americans of non-Chinese origin and you would not 
like to suggest that the Chinese Americans who were involved in these 
cases are Chinese spies and those non-Chinese Americans who were 
involved are patriotic citizens who just made unfortunate mistakes, 
would you?

F.    Your reply also states that CBS "in no way intended to suggest 
that the recruits represented anything other than a minority of the 
Chinese population in this country and we do not believe that we in any 
way suggested otherwise", although there is no mention or implication of 
such statement in the original broadcast. In fact, CBS' choice of words 
in the report portrayed exactly the opposite intention, as shown in the 
following four examples:

1)     CBS implicated the entire Chinese community by using the word 
"ordinary" and by providing no distinction between being an intelligence 
recruit and being an ordinary member of the Chinese population.

2)     Onch again, the CBS broadcast opened by a crowd of Chinese 
visitors coming out of a plane, saying "planeloads of Chinese citizens 
arrive [daily]... some of them may be future spies." The statement makes 
it seem as if spies arrive in every plane, and leading to the 
inescapable conclusion that, since there are numerous planes arrive each 
day, America must be inundated with Chinese spies!

3)     The broadcast stated that ordinary Chinese "will be activated to 
steal America's military and technological secrets, whether they want to 
or not." This statement further implicates the entire Chinese community 
by virtually demanding that the least spy-like person must also be 
watched, because they can be forced to spy against their will. It is 
outrageous to suggest that a freedom-loving, law-abiding Chinese, whose 
very presence here shows an appreciation and understanding of the 
American dream, could be forced to commit crimes against his or her own 
will and against this great nation, the United States of America! 

4)     In the broadcast, the reporter announced that China has a 
"biggest spy network" in America, without any concrete evidence or 
statistical data. She simply asked the interviewee: "Are there any other 
countries that you know of that have this kind of spy network operating 
here in the United States?" To which the eye-rolling interviewee 
mumbled, "No, not-certainly not to this -- to this degree." This broad 
generalization and paranoid imagination creates an overwhelming image 
that there is a China spy network that has infiltrated every home and 
office in America, putting these "ordinary" Chinese under its control!

It is impossible to prove a negative. Mr. Vice President Venardos, if 
you have a neighbor who happens to be an ethnic Chinese, what could he 
or she possibly do to prove to you, or CBS Evening News for that matter, 
that he or she is not a spy for China, since you have expressed so 
firmly a belief in your reply that portraying ordinary Chinese as spies 
is "important" and that the Chinese spy "problem may be even greater"?!

A primary mission of U.S. intelligence agencies is to investigate spy 
threats in the U.S., whether posed by "ordinary" citizens or by 
government agents, and we wholeheartedly support their efforts to ferret 
out the multinational spies infiltrating American business. The job of a 
news organization, such as CBS, is to report and to investigate real 
life events, not to fabricate, distort, and manipulate facts to create a 
fairy tale in an attempt to boost ratings.

It is understandable that there are paranoia about the presumed Chinese 
"spy" threat among some individuals. But as a major network, CBS should 
report it professionally, that is, while reporting the paranoia, you 
should also report those innumerable facts and views that prove the 
opposite. 

On the contrary, the open generalizations and implications of your 
report invite American public to "keep an eye on" and be suspicious of 
their Chinese employees, job applicants, business partners, and even 
neighbors! The eye-catching proclamations in the report were unsupported 
by facts, but a collection of irrelevant stories patched together with 
some vivid imaginations, outright fabrications and unsubstantiated 
allegations. Just because a person is from a certain country of origin, 
it does not make him or her believe in the politics of that nation and 
would sell his or her soul and American secrets for fame or for money!

Your May 19th, 1994 report by Ms. Connie Chung, produced by Mr. Thomas 
Anderson and Mr. Eric Sorensen, is an unprofessional, irresponsible, 
subjective, bigoted, and tabloid style show piece. It defamed all the 
law-abiding ordinary Chinese in this country. Rarely have we seen such 
blatant discrimination against an  ethnic group on national television.

We have fought so hard for the principles of freedom and democracy. We 
will not tolerate being accused of subverting democracy in this country! 
We demand that CBS issue a formal public apology on "Eye on America" and 
devote equal air-time to an objective discussion of this issue. We also 
ask that you respond in writing to the specific points we have addressed 
in this letter. You cannot defame an entire ethnic community by using 
anonymity, getting away with "sources say", "unidentified man", "CBS 
special investigators find" and the rest of those elusory clauses.

The recent Ames spy case served as a reminder that the espionage bussiness in
this country is still thriving; that you don't always find spies in trench
coats and that you could find them in the house next door. In a special
investigation, CBS News found out how China is grooming agents to keep an Eye
on America.

Chung: Every day, planeloads of Chinese citizens arrive legally in the United
States, ordinary people. But to the Chinese government, some of them may be

Are there any other contries that you know of that have this kind of spy
network operating here in the United States?

Mr. Nicholas Eftimiades (Defence Information Agency): No. Not-certainly not to
this--to this degree.

Chung: Nicholas  Eftimiades, who works for an American spy agency, the Defence
Information Agency. His new book on Chinese intelligence raise questions for
American government and business.

Mr. Nicholas Eftimiades: I don't think we can say at this point any Western
government is prepared to deal with this type of espionage threat, because it's
different from anything that we've known to date.

Chung: It all start here in Beijin. A Chinese student or scientist or
businessperson applies for a visa to go to the US. Then the Ministry of State
Security asking questions: What cab you learn in the State> Will you be working
with computer? Will you be loyal to China? And most importantly, can you be
patient? Eftimiades says the prospective spiues are trained, paid and warned to
stay in touch, 'Remember.' they are told. 'we'll be watching your family
members in China.' 'Lay low until you're contacted.' they are told. It could be
years.

Mr. Nicholas Eftimiades: Let me put it to you in the terms that the Chinese
Intelligence Service describes it: Chen di yu, which is a Ministry of State
Security slang term for fish on the bottom of the ocean. This has been defined
in  Western espionage as sleeper agents.

Chung: So they just sit there like fish at the   bottom of the ocean and do
nothing?

Mr.   Nicholas Eftimiades: They wait.

Chung: Until they have to surface.

Mr. Nicholas Eftimiades: Exactly.

Chung: This man is one of those Chinese fish at the bottom of the American
ocean. Call him a reluctunt spy. he's afraid he'll be contacted soon to hand
over state-of-the-art computer programs.

Unidentified Man#1: Never forget, you belong to our organization.

Chung: ' Never forget," they told him, ' you belong to our organization.'

Man#1: You were sent by our organization.

Chung: ' You were sent by our organization, and this organization belongs to
the Communist Party.'

Man#1:...Communist Party.

Chung; Twenty-three years ago this man, Kao Yen Men, came to the US. In recent
years, he lived a quiet life in this house in Cherlotte, North Carolina, and he
even bought a restaurrant in downtown Cherlotte. His neighbors never knew what
he was up to.

Unidentified Man #2: I really didn't know what to think. I mean, you know, we
came down to this nice little Southern city, and the next thing you know I'm
down the street from a spy. I thought this was, like, a little friction movie
or something, but...

Chung: Some movie. After a six-year FBI investigation, Kao was arrested and
charged with trying to steal the advanced Mar 48 torpedo, engine for the FA-18
Homet jet fighter and radar for the F-16 Falcon jet. Kao was caught, but
security expert 'Pat pattakos says most American companies are too naive about
the Chinese spy thret.

Mr. Arion "Pat" Pattakos (Beta Analysis): Right now a lot of people don't
really think of the protecting themselves.

Chung: Especially when the target is information and computer data...

Mr.  Pattakos: They'll look at all this information here that they can access.

Unidentified man #3:  Yes.

Chung: ...all part of the more and more accesible information superhighway.

Mr.  Pattakos: I mean, it's very easy to know when a truck is missing in front
of your place. I mean, it's gone. It's physical object. But think about
information. Information is more intangible, and people may not know--realize
that it's lost.

Chung: pattakos says a new national strategy between business and government
can trap the spies.  Eftimiades is much less optimistic.

Mr. Eftimiades: Once these spies get into American society, once they're deeply
rooted into our structure, our society's structure, we're not going to be able
to detect them. There is no way to stop them at this point.

Chung: The FBI is trying to help American corporation protect themselves from
espionage. The bureau has a program now to brief executives about how their
companies could become targets. Dan.

Dear Mr. Ober:

As president of the Independent Federation of Chinese Students
and Scholars(IFCSS), I am writing you to express my deep concern
over the CBS Evening News report on Chinese espionage, which was
aired on May 19, 1994.

The report, with Connie Chung as the anchorwoman, apparently
aimed at warning American businesses of Chinese information
espionage. However, it was structured in such a manner as might
very well introduce a bias into American people's perception of
ordinary Chinese citizens. 

The report began with these words:

     "Every day, planeloads of Chinese citizens arrive legally in
     the United States, ordinary people. But to the Chinese
     government, some of them may be future spies, who a few
     years down the road, will be activated to steal America's
     military and technological secrets, whether they want to or
     not."

There are several inappropriate points in this paragraph alone.
First, the number of people who might work as spies was greatly
exaggerated. China may or may not has the biggest spy network in
the United States in comparison with other countries, but the
absolute number of spies vis-a-vis the whole Chinese population
in the U.S. is very limited. By using words like "planeloads",
the report greatly exaggerated the proportion of spies. Secondly,
spies are not "ordinary people." The Chinese agency in charge of
espionage would not choose ordinary people as spies; on the
contrary, it relies on those who are most loyal to the Communist
Party. Ordinary Chinese coming to the United States, just like
ordinary Americans going to China, have impeccable business or
personal purposes and are very friendly with the country they
visit. Thirdly, Chinese people are not cowards, as was well
demonstrated in the 1989 Democracy Movement, therefore they could
not be forced to work as spies. Chung's statement "whether they
want or not" is at best a distortion of the integrity of the
Chinese people. It is well-known that despite repeated
intimidation from the Chinese government, Chinese students in the
U.S. are still carrying on the fight for democracy and freedom.
On the same day of this report on Chinese espionage, five Chinese
nationals embarked on a 360-hour hunger strike in front of the
White House demanding improvement in China's human rights
situation, which once again demonstrated the kind of courage
witnessed by people all over the world in 1989.

For ordinary Chinese students, America represents the land of
freedom. It was the American dream of liberty and democracy which
inspired thousands of young Chinese to lay down their lives on
Beijing's streets five years ago. Because of China's human rights
situation, many Chinese students are choosing to live in the
United States for the time being. Instead of spying for the
Chinese government, they are making great contributions to the
American society with their knowledge of advanced science and
technology and fostering a profound friendship between the two
peoples. 

In the past three days, my organization has received hundreds of
messages and phone calls from Chinese student nation-wide
expressing their concern over the report. They are worried that
the unrealistic picture painted by the CBS Evening News report
could negatively affect their life in the U.S.. It is my sincere
hope that CBS will take appropriate measures to mend the damages
done and present a balanced, realistic view of Chinese nationals
to the American public.

about the threat of Chinese government spying on U.S. 
concerns, has come to my desk for a response since I am Vice 
President of Hard News and Special Events.

On May 19th, we reported the Chinese Ministry of State 
Security has recruited hundreds of ordinary Chinese citizens 
to steal U.S. military, technological, trade and computer 
secrets. This, according to the United States Defense 
Information Agency in Washington. Within our report, we also 
presented concrete examples of this having occurred 
(including the arrest of a Chinese restaurant owner in North 
Carolina, charged with trying to buy parts for two jet 
fighter planes.)

Between 1986 and 1993, one in eight of all illegal export 
enforcement cases closed by U.S. Commerce Department 
involved the People's Republic of China. Security experts 
have told CBS News that many of the spy cases uncovered are 
then hushed up and the suspects deported, so the problem may 
be even greater than we reported.

Our report was responsible and important. We stand by it. In 
doing this story, we in no way intended to suggest that the 
recruits represent anything other than a minority of the 
Chinese population in this country and we do not believe 
that we, in any way suggested otherwise.

Furthermore, we have led network coverage of those brave, 
freedom-loving Chinese who have fought government 
repression. We have risked censorship, and worse, to bring 
those stories to the American public. However, our job is to 
bring ALL  stories to the attention of the public, even 
those that may make some viewers uncomfortable, That is the 
very definition of a free press.

If damage IS done because of our reporting on the Chinese 
government's effort to spy on American institutions and 
American business, it is the fault of bigoted viewers who 
draw subjective conclusion from objective reporting. We wish 
we could control that, but we can't.

Hi, netters:
I'd like to share a piece of good news with you guys.  A new round of
processing lad applications seems to me began just a week ago.  My lad has a
priority date of July 1, 1993 like many others.  She handed in her application
in middle August 1993 in Philadelphia INS.  She got a cash receipt at that
time and had not heard from them ever since until last week when she got the
approval letter.  We went to PHil INS to process her I-89 stuff, it just took
about one minute.  In the INS office, we saw about 15 people (lads) doing the
same thing there.  This is just for your information.

Hi,Friends:
	A week after we received a "notice of intent to deny", at July 6 1994,
INS approved my doughter's I-485 application form. Since she is only 4 years
old, her interview has been waived and fingerprint and I-89(?) also has been
waived. The letter said 'She will receive her GREENCARD within 5 mouth.
But my application still haven't been approved.
	Anyway that is a good news for LADS. It seem that Memphis INS starts
a process for LADS now.

Hi, folks,

A friend of mine who holds J-1 got a very nice job offer recently. 
The company agrees to process H-1 for him, but he is facing the 
problem how to get two years waive.  He is a kind of "Gong1 Pai4"
visiting scholar and received some funds from his organization. 
He is willing to pay back those funds, but does not know how to
deal with it smoothly and successfully.

I tought some of folks on this net had similar situations and 
experience, so I am requesting for my friend the related infomation 
and your experience of this issue. Your help will be really appreciated.

IFCSS should be a community based, community orientated organization;

IFCSS should show her competence in community crisis, such as last year's
      lads and lc movement. 
IFCSS should establish its channel to consult majority CSS on important 
      issues such as MFN, Olympic Bid, Congress Hearings, Hunger Strike 
      in front of White House, Demonstrating Against Japanese Emperor's
      visit, etc., rather than holding the current attitude of acting by
      themselves. IFCSS must adopt a mechanism that general CSS will be 
      able to change its course, in anytime, for any reason, when situation
      arises and consensus of general CSS is reached. 
IFCSS should be our very own organization. We must put an end to the minority
      dominance over majority role. This year, only a dozen schools had 
      registered to 6da. The majority schools are not participating at all.
      We must change this by sending more our school delegates to 6da. We
      have seen too many d-fighter's organizations all over the world, and

ifcss should be somewhere between administration-like and congress-like. too 
extreme in either ends will produce negative results.  after all, the delegates 
who participated elected the president for only one year term. those who 
concerned should support their work.  otherwise, try to bid the presidency 
yourself.  d-fighters is used too negatively in this statement.  after all, 
most of us have benefited from what the d-fighters did (I here refer d-fighters 
in a general meaning and included all of those involved).  we all should be d-

Hi, friends, I need your input and help!

I am a LAD and a graduate student.  I came to US as a F-1 and never
lost my status.  Last year my husband become PR under CSPA and I
applied for permanent residency in August.  When I turned in
my application materials to a INS official, she took my I-94 card from
my passport.  I haven't heard anything from INS yet.

Now I plan to go to Canada next week to present my research data in a
meeting.  My advisor has bought the airline ticket and reserved the
hotel for me.  I called the Canadian Embassy at DC to ask information
about getting visiting visa as a student.  Apparently, to get a visa
to Canada, I need to have a valid original I-94 form, or, they said
that I have to wait until I finish my PR process to visit Canada.

I went to the INS to apply an Advanced Parole two weeks ago but
haven't received it.  The meeting in Canada is in 10 days and I have
to finish all the paper work and get my visa before that!  My
questions are:

1. While pending for PR, what kind of status I am right now?  The
INS official said to me,"You are a F-1 student, why don't you go to
Canada as a student?"  I said, "But they need a I-94 form!"

2. Has anybody go abroad after submitting the PR application but
before the interview?  How do you get a entering visa?  I even don't
have a A number, should I think myself a PR-to-be when going abroad?

** 3. What should I do now to enter Canada for the meeting?  If I get
the Advanced Parole in time, do I need a visa for Canada?  I mean, does
PR need a visa to go abroad?

Hi, everyone,

I need to get the official source that LAD's EB3 visa number is with
July 2, 1993 cut off date. This is very urgent.

Today, after keep waiting for weeks from our local INS(West Palm Beach,
FL) for the interview notice ( I am CSPA LAD with priority date 7/2/93 ) 
I receive a letter from our local INS office said that "A visa number 
is still not available for you. We expected one may available in September". 
I think they must be wrong on this because how come EB3 for LADs available for
7/2/93 from all other INS office but not this one??

I need the official source to show them when I go there next time. If
any one have any idea where to get it on the net?

Please help. Any info is very appreciated!

My understanding is, cutoff date being 7/2 means those with priority date
on or before 7/1 are eligible for visa. Your priority date is 7/2, so maybe
that's where the problem is.

But I am not 100% sure.

visa and my wife has H-4. If I understand correctly, my wife has not yet lost
her status although I applied. But if my application is approved, then my

   I wonder what options I have now. I hear one option is to apply for
voluntary departure, although it does not maintain the applicant's legal
status. I would very much appreciate your response and help.

H-1 has dual purposes, so you do not lose your H-1 when you file CSPA. But
since you can not apply EB3 for your wife (only if you have 7/1 priority date
then you can), and no FB2 (since you have not been approved), so you have
to wait for your approval or the cutoff date gets you. In current situation,
it is most likely you will get your approval notice before your wife can file
I-485 for any category. Once you get approval, you wife is out of status.
One way to avoid this hardship, is to apply B-1, F-1, any other independent
non-immigrant visa for your wife. Say, find a language school (well, you 
should have to capacity to let your wife to study English, do you?), and get
an F-1 for her. Then, when you get approval, apply for her FB2, whenever 
cutoff dates catches you, file for her EB3.

Hi! Everyone:

I recommend Mr.Mi Mi Sr.(Huang Lin?),Jun Wu,and Xiang Dong to be CSS
delegates to the 6th IFCSS. my justification is simple and clear:

1.CSS need a leadership who cares about the community needs and concerns.
  ---- e.g. CSPA lads, lads-lc cordination...
2.CSS need a service-minded character in IFCSS on a regular basis to handle
  CSS' interests and even possible crisis, more efficietly.
  ---- e.g. Fighting CBS..
3.IFCSS should be CSS' very OWN organization and local CSS Commitee should be
  consulted,when IFCSS makes major decision.

We need your name, address, affiliation and phone number, and a short 
statement to appoint us as your representative, to make us eligible.

Mi Mi Sr. plans to go 6da himeself, upon the approval from Mi Mi Jr.'s Mom,
and probably will take Mi Mi Jr. as well (upon approval, of course). He has
not gotten positive response from IFCSS 6da if such a lads-l representative
is valid in any sense, but to the best understanding, a student delegate
must be from a locally registered CSSA, and a non-student delegate must
from a club with at least have ten persons. We are sort of new form of club,
a club in which almost no one meets each other, and a club rides on the
information super highway!

The more people we lads-l get involed, the more unlikely we will be turned
down!

Lads-l only can have one vote, to the best of my understanding, if we can
actually have. So, it is me if anyone makes the trip finally. I think my
standing to 6da is, 

1) We need an ifcss who cares community, such as lads-lc affair, and serves
   community first;
2) We need an ifcss who responds quickly and competently to crisis 
   concerning CSS in general, such as fcbs;
3) We need an ifcss who cares majority CSS's opinions, and will consult
   majority css on the issues such as MFN, Olympic Bid (I was against the
   bid, but as the representative of CSS, ifcss should consult CSS first),
   and this year's hunger strike in front of the White House. We can not
   afford to have only once per a year leverage to control ifcss what she 
   should do next whole year, while even this kind of leverage is easily
   be abused and deprived. We need a constant, year-around channel to 
   to demand what we want. It is ridiculous that, a bunch of aliens could
   lobby U.S. Congress while the same bunch of alien can not lobby their
   supposed "very own representatives"!

The above is my ideal. I am not running for any offices.

I strong sopport Mi Mi Sr. Jun Wu and Xiang Dong to be our delegation members
to the 6th IFCSS Convention. Based on Mi Mi Sr's extrodinary service for LADS
and loving energy contributed to CSS community, I think he is highly qualified
not only for the LADS delegation member, but also for the leadership of IFCSS.
He is a few among us who send so much time and energy to serve the CSS commu-
nity. Most important, he is a matured leader with elegant leading skill. As a
leader of IFCSS or The LAD committee in IFCSS, he is the person I can count on
although I never met him before. So, why we just send Mi MI to the 6Da asa
small LAD delegation member. He can do much more for the CSS community. I would
like to appeal to all LADS netters and CSS to elect MI Mi Sr. as one of the

Hi:
I called Texas ICF (Immigration Card Facility) and answer machine said
that ICF had received my lad's copy 2 of I-181, but need approval copy,
copy 3, and I-89.  In CSPA, as I know, approval notice is I-797. Do anyone
know what is I-181 and is there anything I can do to help the case?

   Hi:
   I called Texas ICF (Immigration Card Facility) and answer machine said
   that ICF had received my lad's copy 2 of I-181, but need approval copy,
   copy 3, and I-89.  In CSPA, as I know, approval notice is I-797. Do anyone
   know what is I-181 and is there anything I can do to help the case?

No big deal: I traced Mi Mi Jr.'s card production. They just recorded some
internal routines which no outsider understands and can explain. Do not
worry about that. They are just trying to piece together everything for
your card, making themselve look busy all day long. 

You really do not care that much who is doing your dream car's tire, brake,
or transmission, do you? Just sit back and relaxe. When ICF pieces everything
together, then it takes 45 days (wow! how efficient they really are! I
thought of 45 years before!) for you to get your card.

compaign for IFCSS presidency (therefore, not any ifcss executive positions).  
if he do, he should let every CSS know (not just lads).

I am not opposing this idea, but don't want to receive hundreds of signature 
over the weekend.  after all, i am not the person who want to represent you.  
please send to the person involved, and then the person concerned can use the 
signature to communicate with 6da organizer.  if you want to say sth other than

In two days, I got more than 40+ signature files in supporting me to the 
6da as lads-l CSS representative. Many even suggested I run for the 
Presidency. Well, I do not have enough courage to do that. It does not
mean I am a coward. One may be good in one thing but not good in other.
IFCSS President is something too big to me, and I do not want to make
you feel disappointed. 

Meanwhile, I will do my best to serve the general CSS community whenever
situation arises. 

Now we have two choices: L/L and X/L camps. Both I have been working 
together, and I really feel both are good choices. It is pity that we can
only pick one pair! Liu Chengyan was our chief-rival last year, when he
headed lc-l. I feel he is much mature now, and is a hard working fellow.
Luo has very good ideas, I talked with him many times over the phone,
and admire his talent and devotion. Xing is also a hard worker with whom
we have been "gang of four" for Zhao Hua's case. I do not know much about
Liu Yuhe, though.

One thing I will present, is fcbs report. 
One orientation I will emphasis, is community orientation, community affair
    first, and community bound.
One bill I will push all the way through, is "poll on CSS". We general CSS
    can not afford to be miss-represented any by anyone any longer. Our 
    fcbs survey team is drafting such a bill.

By my understanding, I-181 is like an approval letter from local INS.
Your LAD should receive the copy-3 of I-181 and bring it to local INS  
to process I-89. Then the local INS will sent the copy-3 of I-181 and  
I-89 to ICF. That is the normal procedure.

Hi, netters, it is possible we can have a vote in 6da. And I am going (not
runnig). 

First, I will present the working report of fcbs-l, which is the most popular
css movement right now. Second, I will bring a resolution for direct opinion
poll on css before ifcss making any major postions, such as MFN, and hunger
strike. Third, I will stress the importance of community services, such 
as lads-l and lc-l.

Hope this will help.

Now, which pair you guys prefer? L/L or X/L pairs? I am polling you right 
now. And I will vote for you, since you trust me as your representative.

There are only two sentences in the form. The first told us that the
application process has been completed. The second one is: "A request
has been forwarded for the allocation of a visa number." It did not
let us go to local INS to process I-89. What should we do? Just wait?
BTW, is this the approval notice? Does this mean that we still need to
wait for the avilable visa number? Any help is appreciated.

My wife a similar copy.  But the setence "A request has been forwarded  .."
was crossed out.  We did not do any thing but wait.  Now she got it.

Your wife's status is the same as mine. I got pratical training card on 
4/30/93. I applied for form I-485 in Auguest, 1993. At the same time I got  
employment authorization appointment sheet. The sheet said that I would go  
to 201 24th steet Immagration office to get the EAD card based on the form  
I-485. Now the card almost is expired. I went to 26 Federal building to get 
appointment sheet to extension the card about two weeks ago. Today I just   
got new EAD card. But I have not heard anything about my PR processing from 
New York INS.

Hi, thanks for all your support, I was qualified as the delegate of lads-l to 
6da. In the 6da, I met many friends from lads-l community. It was hard for me
to remember so many faces and names I never met before in such a short period,
since I am so poor a person to remember all of these. However, I will never 
forget the warm greetings from all of the network friends, and appreciate your
heartful support and appreciations. I will try my best to serve you whenever
situation arises in the future. 

I took a amendment to the constitution, the main point is to set up a polling
system, so IFCSS HQ can not do the "fast" thing, and general CSS can be 
constantly heard. The amendment did not pass, although I managed in the last 
minutes to submit it to the Congress. I got registered as formal delegate
half hour into the meeting, and I had to find four others to sponsor it, then
20 people to co-sign it (from then 105 delegates). So it was very tough. 
But, the bill was killed, since the goals were not clear enough, and 
the amendment is almost the length of Constitution itself. So,... We will do
better next time. 

The response to my "polling lads-l", the majority response supported Luo/Liu 
and not even one against them. So, as the public endorsment of the lads-l,
I cast the vote for Luo/Liu. Luo/Liu finally won the race despite many rumors
protraying them as "CCP spies". I was shocked to see those who launched such
a dirty campaign to destory one pair's credibility, those who copied "class
struggle" tactics and still claim that they are for democracy, human rights 
and liberty in China. It is no wonder why those d-fighters have been losing 
their credibility so fast five years after 6.4. They copied the notorious
mentality of Cultural Revolution. I was glad that the 6da used police force
to shut those class-strugglers out of the meeting. But this interruption
prevented me from giving report on CBS/CNN incident. All the seminars were
cancelled due to this incident.

1. Is there anyone, by any chance, to know how long it will take to become a
   residence of US after getting Green Card (PR) as a CSPA principle (6.4 card)
   in US, 3 years or 5 years?

After I posted the information that one out-of-status LAD passed interview
in Guangzhou yesterday, I received several email requesting more detail. 
Instead answer to each individual, I post it to the net.

The person came to the states with B-2 visa and lost status just before his 
wife filed for GC under CSPA on 7/1/93. The wife filed I-824 with eastern 
center for him in Oct. after her GC was approved. They chose China as interview
country (actually they chose Beijing instead Guangzhou by mistake, and, 
fortunately, INS corrected it by signing and sending every thing to Guangzhou).
On 6/27, they received the notice of interview from Guangzhou US Consulate. 
The interview was taken yesterday (7/27/94) and it was passed smoothly. I 
don't have the detail story about the interview yet. One thing one should bear 
in mind is that TWO COPIES OF THE NON-CRIMINAL RECORD IN THE USA IS NEEDED 
which can be obtained from your local police station and state criminal records
control board for free.

WJ reports (07/25/94) that, until end of May, INS had received 57,027 CSPA
applications, amount them 48,070 had been approved. Dr. Zhao Haiqing estimated
that, there are nearly 70,000 lads waiting to adjust their status in the U.S.A.

Dr. Zhoa mentioned the effort to relocate lads in the world-wide pool, but
he admits that this is not easy. 

90 day rule is difficult to change, and EWI is not eligible for CSPA.

Thanks to the information superhighway, the lads on this net are organized
and the process is quite smooth up to now.

  We recently read a message from World Journal which said that LADs over
21 years age whose applications for green cards  have not been approved
must  reapply for GC under category F2-B using I-130 form.  We were
lads who filed the applications and got interviews before we were 21.
Now we already passed 21 while waiting for visa number.  We wonder if
we automatically became ineligible for GC when we pass age 21 during
the waiting process.  We think that passing the interview means
approvals for GC application, so our situation might be different from
the situation mentioned in the newspaper, and therefore we should not
have any problems getting the GC due to the age limit. 

  However, we know little about the INS policies regarding this issue
under CSPA.  It is beeter for us to prepare for the unpredictable. If
we have to reapply, what kind of process should we go through? Would
someone kindly guide us and provide related information  concerning
this matter to us. Thanx.

I have checked the World Journal, it states that there are around up to 
70,000 LADs waiting INSIDE U.S. for approval, not 7,000. So, translating 
into number per year, it means that, between 4/90 and 7/94, roughly 15,000+
lads per year had entered U.S. I believe this 70,000 is way too high, but 
we will not protest it like mad as we did for CNN :-). Well, you may contact
Dr. Zhao to confirm this.

Sure. There are a lot of so called CSPA principles that used false
documents to enter the CSPA catagory. Everyone knows what Chinatown
is like. You can do anything if you have enough money. Need birth
or marriage certificate? No worry, give me money and I'll give it
to you. Passport expired or actually don't have a passport? Don't
worry, give me money and you will get a new one. CSPA brought a
great opportunity for some self-claimed immigration lawyers to
make dirty money and for more illegal immigrants to enter legal
status. These illegal people certainly have much more lads than
honest students.

I know some people who entered U.S. illegally have got their green
cards under CSPA. They told me that because they don't know English
at all and they need my help to apply GCs for their lads. When I
reapplied my work permit in June, I saw a letter at NYC INS which
stated that "Thousands of applications have been transferred from
Eastern Service Center to this branch. We are scheduling a project
to interview these applicants from October 1994... Some applicants
may need the help of a translator." I guess that's why no lads in
New York have got anything from NYC INS. They are busy dealing with
those faked CSPA principles. They just don't have time to take care
of lads in New York.

No, I can hardly agree. I will not take all of the ill-behavior of the others
as mine. Mafia is not Chinese, right? Each people has her own gangsters. 
Undocumented Chinese are not gangsters. Although I do not agree with their
method to enter U.S., but, the way to enter U.S. is much much too dangerous,
too expensive and difficult, and too less could possibly make the trip for 
Chinese than any other nationalities. So, I am sympathetic to their plight. 
That was why we fought CNN for the correct numbers. First of all, we are 
Chinese, the second is we are Chinese, and the last thing is, we ARE Chinese!

the impact of Monday's report and the repeatedly running 
promotion last weekend.

	According to the official US government documents, which are 
based on scientific surveys and statistics, the Chinese illegal 
immigrants is less than 0.8% of the total illegal immigrant 
population [*]. It is much lower than many other ethnic groups. 
As a demonstrative example, in New York City which draws more 
than half of the illegal Chinese immigrants in the country, 
Chinese illegal immigrants ranked only 13th among other ethnic 
groups, lower than those from some developed countries [**]. The 
extremely questionable 10% figure quoted by Mr. Wian, which 
amounts to hundreds of thousands, is from private sources, which 
is to be validated for its accuracy and credibility. A balanced 
report should at least quote the official US government 
statistics.

	Even if we grant full credit to the investigative capability 
of your private sources, Mr. Williard Myers, who was the major 
interviewee in your program and your major source, an expert on 
Chinese illegal immigrants, authorized us to make the following 
statement:

	"Other than direct expenses of enforcing the law, the 
Chinese who has entered the US by irregular means do not cost a 
penny from the US government and American taxpayers". 

	To the contrary, Mr. Myers pointed out, in his communication 
with us, that the Chinese illegal immigrants make positive 
contributions to the US economy and American society by working 
in Chinese owned businesses, which has been expanding by the 
extra source of labor. To express it explicitly, they do NOT take 
other Americans' job away! Furthermore, contrary to the 
impression caused by other sectors of illegal immigrant 
population, the Chinese illegal immigrants do not rely on social 
welfare provided by the US government.

	Therefore the report is irrelevant to Moneyline because the 
financial aspect of the report is totally groundless and a pure 
extravaganza. The Chinese American community, as part of the 
people of this nation, shares the anxiety of most Americans about 
the illegal immigrant problem and welcomes a balanced report 
which covers not only the Haitians, the Mexicans and the Chinese, 
but also the illegal immigrants from other countries. However, 
singling out the Chinese as scapegoats just because the images of 
the boat people are striking and "news worthy" seems to have left 
the high standard of journalism, which CNN has always held, 
behind. This will not contribute to the racial harmony all of us 
are striving for in this great nation.

	Based on the aforementioned facts, we believe that it is 
fair for us to ask you to acknowledge on Moneyline that your 
program and the ongoing promotion have created a wrong 
impression, that is, the illegal Chinese immigrants are coming to 
America taking bread and butter away from our dining tables!

	The public has the right to know the truth, and the Chinese 
Americans, who are immigrants or descendants of immigrants from 
last few hundred years just like most people in our country, have 
the right to be cleared from images of any evil intent. We cannot 
tolerate any accusations and reports which may stir up anti-
Chinese sentiment, and we are paying attention to the media to 
assure fairness and accuracy, and to fight any racist 
allegations. An air apology and clarification of facts will be 
very helpful on this regard.

	Thank you for your precious time and attention to the

I am a CSPA principle, and have already gotten the green card. 
Last month, I filed I-824 with Western Service Center for my
wife, who might be considered to be out-of-status. However, the 
application was returned with a message. It said that WSC can't 
accept any "direct mail" fees on this type of application/petition,
and asked to contacts the local INS. 

Now the questions are

(1) How to file I-824?
(2) Where to go?

I would like to have any suggestion or information, any help
will be appreciated.
