(1) If he plans to go back to China through Hong Kong, does he need a visa from British Consulate ?
(2)Does his trip back to China have any effect on his appending status for green card ?

Hello. I came across the following on the internet. It is about a 
immigration reform bill. There is a great back-log on the visa numbers
available for new PR's family members who are abroad (in India or China
for instance). This campain is geared to support a pilot program for
a reform bill. Not just the Indians, Chinese may suffer from the same 
problem because the cut-off date of available visa for Family-Based Priority
2 category (for new PR's family members in China) is Aug. 1991, lagging back
three years! Please help as much as you can. Thank you!

Dear Honorable .....,
     
   Action-India is a worldwide, non-profit, voluntary organization of
people of Indian origin residing outside India, that conveys the views 
of the Indian community to lawmakers and leaders of representative 
governments. Professionals for Spouse Reunification (PSR) is a voluntary 
organization comprising immigrant engineers, doctors, educators, 
scientists, and other professionals.
     
   The Spousal and Child Immigration Bill (S.618 & H.R.3182) seeks to
provide for temporary visits to U.S. by spouses and children of permanent 
resident aliens; the bill will provide temporary relief and unite the 
nuclear family of permanent residents that is now forced to endure a long 
and painful separation of three to five years due to the backlog. Senator 
Donald Riegle Jr., along with 10 other Senators, has written to the 
Secretary of State suggesting the implementation of a temporary pilot 
program based on the provisions of this bill. We request you to support 
this "Proposal for a Pilot Program for Temporary Admission of Backlogged 
Spouses and Children of Permanent Resident Aliens" and also convey to the 
State Department our views in this regard.
     
   The bill seeks to redress the inequity that exists in denying visitor
visas to spouses and children of permanent residents, simply because they 
have already filed category 2A visa petitions; the bill would help put an 
end to the needless separation of families (it takes upto 4 years for 
processing category 2A visa petition). The proposed pilot program would 
test the effectiveness and practicality of the principles outlined in the 
bill.
     
   It is important to note that neither the bill nor the pilot program
will add even one permanent resident to the total number of immigrants 
admitted to the U.S. each year. The pilot program, which is for 18 
months, is subject to review every 6 months; the Congress has in the 
past, often adopted immigration policies after testing them out through 
pilot programs.
     
   We therefore request you to call the Secretary of State Mr. Warren
Christopher and convey your support for this pilot program, and thereby 
help subject the provisions of the Spousal and Child Immigration Bill to 
a careful scrutiny. We welcome any communication with Action-India and 
PSR, which may kindly be directed to the Chief Coordinator of 
Action-India, Mr. Sunondo Ghosh.

     INS at Arlington (VA) is processing the LADs applications.  By
the end of May this year, one of my frinds received a letter from
INS which asked for the employment letter for LAD.  Today, another
friend received a letter fron INS.  The content is as following:

Applicant's name:
The processing of the application for adjustment of status to
that of permanent resident filed by the above named individual
has been completed.  A request has been forwarded for the
allocation a visa number.

                         Sincerely,

                         (signature)

                         District Director

     At the bottom of the letter, there was a red stamp showing
"approved" with another person's signature.
     We have a comfusion on this letter: does the "approved" stamp
mean that a visa number has already been issued to the applicant
after the forwarding of the request for visa number ?
     We greatly appriciate any answer.  Thanks in advance.

the local Chinese newspaper, World Daily, reported that the priority date
for employmennt based visa applicants (EB3) has advanced to July 5th/93.

I have just talked to the immigration consultant at our campus (UCSB)
to confirm that the priority date for employment based visa category
(EB3 and EC6) has advanced to July 5/93. The consultant said "YES"
shortly after she check with the infomation from INS channel, but,
she added, "the priority date will be 7/5/93 after September 1, 1994."

So, those netters who have LADs with priority date before 7/5/93 will
feel some releaf. Especially those PR with children or wife in China,
now they have much better chance to unite with their family members and
love ones.

President  Clinton  has  decided  to  modify a restrictive asylum policy on
Chinese  immigrants  who  claim  they  are fleeing coercive family planning
practices to allow some individuals to remain here on humanitarian grounds,
U.S. officials said yesterday.

The  new  policy  will  be  presented  in Capitol Hill briefings today, the
officials   said,  and  it  is  expected  to  open  a  new  debate  between
antiabortion  legislators  who seek more open policies and those whose main
concern is the fight against immigrant smuggling.

   About  1,000  Chinese  are in detention around the United States because
they  were  caught trying to enter the country illegally on smuggling ships
or by other means. Many have sought asylum on the grounds that China has an
abusive   family   planning   policy  that  includes  forced  abortions  or
sterilizations.

   Administration  officials  said the new directive seeks to clarify their
status and set policy for the future.

   It  will  remain  difficult  to  win  asylum on the grounds that China's
policies  are  cruel. Only those demonstrating that they specifically could
be persecuted will be allowed to stay here.

   But  the  officials  said  Clinton wanted to create a mechanism by which
some  of immigrants would be allowed to remain in the United States instead
of being forced to return to China when they are denied asylum.

   Under  the  new  policy,  directors  of  Immigration  and Naturalization
Service district offices will be given leeway to grant stays of deportation
on humanitarian grounds.

   The  Bush administration had a more lenient policy of granting asylum to
Chinese who simply claimed they feared persecution for their views on birth
control.
   Clinton's  decision  takes  on a special importance because for the past
year the administration has been waging a battle of perception with Chinese
immigrant smugglers.

   Some officials within the administration have argued that the new policy
sends a welcoming signal.

   Acknowledging that a vigorous internal debate has been waged for several
weeks,  an official speaking in support of the policy change said, "we want
to provide some relief, but we don't want to send a signal that the door is
open."

Dear friends: Last week I asked information about lads PR application. Thanks
to all the people who responded. I really appreciate their help very much.
Now I still have some questions. After I file I-824, what the steps will
be? Because no any spaces in I-824 I can fill in for my dependent's
information, i.e. name; adress in china..... So I assume she (my daughter
in China) should go to U.S. consulate to apply P.R. visa actively rather
than the consulate inform her to do so. Is that right? I would like to ask
some friend who has the experiment to tell me what the procedure will be
after I file and get "prove" notice from INS or U.S. consulate in China.

Notifying appropriate INS office for address change is necessary.  If your
wife's case is still under processing by your local INS, you have to
notify your local INS, and they may transfer her case to the local INS of
your new place (esp. if you are moving to different state). If the case
has been completed by your local INS, and has gone to Card Production
Facility, then you just need to notify CPF by sending then a normalized
form (which is designated for correspondence with CPF only, and is
available in any INS office).  In other words, you may have to go your
local INS anyway.  Then they will tell you what you should do.

BTW, changing with post office might be okay.  But you are taking the risk
of delaying to receive your card.  The post office is not supposed to
forward GC.  Rather, the card will be returned to CPF, until they are
notified of your new address. 

Judging your case by yourself.  You may leave your case to your previous
local INS if you don't like it to be transfered (transfering to a new INS
may cause some delay for processing), however you have to be prepared for
interview with previous INS also.  (What do you think if you are going to
move from NY to CA?)   But in any case, you have to notify CPF about the
change at one or the other time.

	My girl-friend is a LAd with the priority date at July 1st, 1993.
She had her interview in Chicago INS in early August 1993 and was told that 
she would need to do nothing but waiting for the visa number. There were no
more information from Chicago INS till this week. She was told that her 
application was denied. The letter from INS is as follow:

	Decision on Application for Adjustment to Perminent Resident

Dear ***,

	Upon consideration, it is ordered that your application for status
as a permanent resident of the United States be denied for the following
reasons:

	Section 203(d) of the Immigration and Nationality Act allows for a
spouse or child entitlment to an immigration visa and the same order of 
consideration if accompanying or following to join, the principal alien
spouse or parent.
 
	Your application for permanent residence was based upon the provisions
of the Chinese Student Protection Act of 1992, Publication Law 102-404. At 
the time of filing, you being a child of a principal alien, ***(her mum's
name), who had an approved application to adjust to permanent resiednt status.
A child as defined in Section 101 (1) of the Act is an unmarried person under
twenty-one years of age. On March 11, 1994, you reached your 21st birthday,
however, visa availability based on the classifiction that your permanent
resident application was filed was unavailable until July 1, 1994. Thus you
are not entitled to adjust status to permanent resident. Your application is
denied and any previously approved work authorization is revoked.

	Your lawful permanent resident  parent may file a visa petition for
you on a family sponsored 2nd preference, unmarried daughter, twenty-one
years of age or older.

	From this letter, the main reason she was denied  is that she passed 
her 21st birthday this March and the visa number wasn't available till July
1st. But as I know, the visa number for EB3 was once at July 2, 1993 this
Fabruary but somehow moved back to July 1, 1993 later. In Ohio, a lot of LADs
with the same priority date as hers got their approval letters & GCs before
March 11, 1994. But in Chicago, nothing happened on LADs till recently. We
think it is unfair that she was denied only because of the local INS's less
efficiency. We plan to hire a lawyer and appeal for it. But we need help on
this legal process desperately. Any information or suggestion will be deeply
appreciated. Thanks in advance.

Now that the priority date has advanced to 07/05/93, it seems that more
lads should be excited, but not those in New York City. While more and
more lads have got their GCs in other areas, lads in NYC are still waiting
for their first letters from INS. Maybe NYC INS is too busy to deal with
lads. It has to deal with those (so called) CSPA principles transferred
from Eastern Service Center. I'm wondering how long we have to wait. I
remember that, several months ago, rumor had it that some lads at NYC had
been approved. Is it true? Anyone can confirm it?

My priority date is on July,2,1993.  I never hear anything from NYC INS. I  
got extented Employment Authorization card from INS last month.  Now cutoff 
date is July,5, 1993.  Does it mean I am elegible for getting Visa number? I
am wondering if we could contact NYC INS?  Is there any way to meet INS 
officer? My friend who lives in Baltimore got LAD's PR through meeting local
officer. Actually, the friend's file was already approved at that time, but 
INS did not send the approve notice to my friend.

My PD is 6-30-93. Theoretically, I should have no problem getting
approval at all. However, there is nothing to hear so far in New Orleans
area. My lawer has written many many MEMOs to the local INS and never
get any response. The lawyer said that people at INS were just lazy.
They are lazy or not, use your own judgement. They are governmet, there
are really no too much we can do about it except keep writing.
