Out status lads will be able to apply GC inside US beginning from October.

The Chinese newspaper "World Daily" reported that on Friday, August
18th, 1994 congress passed a new law to allow out of status immigrant
to apply permanent resident status inside US. This law has been passed
in Senate twice and will have no problem been passed again in Senate.

The above news appeared on World Daily on August 19 1994.

      	I am a LAD of CSPA and filed my I-485 application form last Sept.
during the " Opening window " time. I had a letter from local INS office
titled " Notice of Intend to Deny " on July this year and I had wrote two
letters to LADS asking help durinh July. 
	The reason INS gave me this letter is that My husband registered only 
6 credit hours which is less than the school international student affair's 
full-time student reguirment when I was in F-2 status in spring 1992(I am a F-1
student now). So he was consided not maintain his lawful status and therefore I
was consided not maintain my lawful status, also. But the fact is my husband was
full-time TA and just enrolled for thesis work that time and actually I had 
change my F-2 to F-1 successfully at summer 1992. There were many unfair and 
ridiculous point in this case(lawyer's words). After I wrote my case to e-mail,
I got a lots of suggestions from e-mail friends and most people belived that
we will not have big problem in this case. For safety reason, we still hired 
a lawyer to rebuted this case for us. Unfortunately we finally lost this case 
and my I-485 application was denied last week by INS. 
	There were nobody clear about this special reguirement until last 
summer in our school and many students made mistakes without any advise and 
warning. Since our school DSO gave international student real hard time and 
there were three international students had been debied their practics training
applications by the same reasons before my problem came. Based on same problem,
we guess that INS dose want listen to us at all from beginning.
	INS returned my I-94 and said if I did not violated my F-1 status I am
still consided keeping my lawful F-1 status.
	We are confused about that. Does that mean I am still a lawful F-1
student and can legally stay in USA and can go a practics training process to 
get my GC ? How to explain that I am still legal F-1 but I didnot maintain my
lawful status. That really confuse us in this case. If someone can explain that 
to us, we will so appreciate about that!
	Now the urge thing to us is what should be our next step? What I can do
to apply PR as a dependent of CSPA?  File a application as DED ? or finish 
thesis then go a regular way to apply GC. We ask help from you e-mail friends.
	Based on our limited understanding about CSPA, we might have a lots of
misunderstanding. We heard that a lawful status only counts from your last entry
to USA. Is it right? If it is right, can I reentry USA from Canada to gat a new
I-94 and then file I-485 application again (it may be filed for family based
cetagory)? Or the only way for me is to file a I-824 as DED to get my GC? Is
this necessary to reentry this country again? What will be a fast and possible
way for me apply a PR? Since I am still in school it is possible for me to get
another I-94 throught reentry now. We really need your help to get next step.
Since this time lawyer was failure to win our case, we think that the people 
who is fimiliar with CSPA are chinese students around e-mail. 

	Any helps and suggestions from you will be highly appreciated!

Dear Netters,

I am posting a few questions for my friend and would
appreciate any advice from the netters.  My friend
got his Green Card last year through CSPA.  His priority
date is July 14, 1993.  He has worked in Texas, somewhere
between Houston and San Antonio, for about 3 years now.
Earlier this summer he went back to China and got married.
His wife is now here in the US on a business visa, which
will expire in a few months.

The questions are:

(1) Is the window that his wife can apply for GC in EB3
category open?  If it is open, when will it be closed?

(2) Can his wife file I-485 in the EB3 category right now?
Where to file? Does she need a Physical Exam right now
or wait until later?

(3) Can His wife file I-485 in the Family Based 2nd Preference
right now? Where to file? Does she need a Physical Exam now
or wait until later?

(4) If her application is accepted, does that mean she can
stay here legally after her business visa expires?  Does she
have to return to China to apply fro GC?

(5) Does anyone know that status of the family reunion bill
in the Congress?  Does that bill have any effect on her?

I look forward to your answers to part or all of the questions.
I especially would like to hear from people in similar situation.

One of my friends has a daughter who is a lad. She alread got her first 
letter from INS asking about principal's aproval documents (I guess this 
is a standard letter that many lads got in New York area recently). Now 
my friend decided to bring his daugher along for a vocational trip back 
to China. The  question is how to apply for an advance parole? Especially 
for someone who shared similar experince would be great help. What kind 
of procedure should he follow? How long does it take to get it? What 
would be the chance for her to get actual PR before she goes to China

Dear netters:
I am seeking advice from netters who had similar experience.  My wife is a
lad.  She sent in her application last year.  She is one of the lucky ones
and got approved and passport stamped early this july.  Last week (after two
and a half months since her passport was stamped), I called the INS card
facility.  Unexpectedly, the message was "INS has not received any
application to make a card for this alien".  I wonder what is going on?  Maybe
the INS is too sloppy as they are to update the message system (for 2 months)?
or the local INS (Phila) is so sloppy that they have not sent the application
to the card facility yet?
I guess there should be no problem.  But, if anyone has the similar
experience, please give me your advice.  Maybe I should write a letter to the
local INS office for further confirmation.

many netters mentioned the letter ( form I-181B ?), which has the follwoing

I just wonder if this is the final approval notice.  if this is it, why there

I don't think this is a "final approval notice" which usually
is form 797 and has a line says "Notice Type: Approval Notice" 
on top portion of the notice.

    I am sorry, the mail system behaves really strange today, I don't
know what the sys admin did to it.  I apologize again for the junk mail.
I just want to thank al l of you guys who replied to my message.
So it (form I-181B) seems to be the final notice from my local ISNS
office.  But since I need to have my address changed, do I need to call
the INS office or the facility in Texas? (the INS office did give me 
an address change form , though) I aasked this 'cause I heard people
say we need to call Texas directly for address change.

(1) I got my PR though CSPA. My girl friend came to U.S. in 1991. We are
planning to get married soon. My question is whether she is qualified as
LAD after we get married.
(2) And if so, under what category she could apply for PR.
(3) And how long will she have to wait for the approval. (I turned in my
application for PR on July 1st, 1993 myself.)

  Thank you for all of your kind answer about the question of the independed 
over 21 years old to apply PR following by Fb-2. (his parents are PR).
  I summary the answer as followed:
  It will take long time to get the approve of PR (10 years) without affacting
of applying visa in US to keep legal law status during waiting period. He has
to keep unmarried until it approves. 

   I still has sth. that is not quite clear. 
   1.  After he applies PR following by Fb-2, can he ask for working permit
from INS during waiting period? and
   2.  When his file is pended in INS (Which might take 10 years to approve), 
does this mean that he has legal status to stay in US because of this and there
is no need for him to get any visa to keep legal status?

   Appreciated for your kind answer and thanks for any response!!!!!

Dear Friends,

	For those of lads who applied in Chicago
INS and have not heard anything since then a visit 
to the INS office may be a worthwhile trip.
My wife applied as a LAD in last August and interviewed
in last October.  Her priority date is 7/1/93.
She had not heard from INS since the interview.  
We went to the INS today and the official seemed a little
bit embarrassed to find out that they still kept her file
"under drawer".  Well, she got approved right away and had
her passport stamped.

The information from Guangzhou Consulate indicates that only when the married 
date is prior to your PR approved date, can your spouse be qualified as E-3 
category.  Otherwise, you might have to apply for FB2 (?), which quite new to 
me.  I am also seeking the answer to the answer for second part.

No.  You have to keep your status because you haven't filed your I-485 - application to adjusted PR status.  Actually, you can't because of a late priority date.  Your petition for him to file under Fb-2 is approved only means that he is eligible to apply under that category.  It doesn't mean that he can apply now. This is quite different from applying under E-3.

Hi, everybody:

   I remembered I have read some reports about car accident in the e-mail
before. At that time I felt very sorry for those people. Now the same thing
happened to my friend. This gives me a big shock.

My friend is on Rd A. The direction is from South to North. She wants to have a
left turn to Rd B. Rd A is two ways and one lane on each way. There is no stop
signe of both direction. (from South to North; from North to South) Rd B is two
ways and one lane on each way too. There is a stop signe of both diretion. (from
West to East; from East to West). Rd A and Rd B are local, not high way. There
is a car followed her. After she gives a left signal and have a turn. The car
followed her hit hers. That car right corner hit her left door. At this time
there is no waitness seeing all of this scence. The sound of two cars crashed
makes residence come out to help my friend out of car. And at that time she was
crying and she got shock. (if nobody help her, she can't get out of the car \
because the door's shape changed. ) She was crying and didn't know to tell peopl
e what happened. When policeman come, he even didn't survey and didn't ask my
friend anything and give her a ticket. Because it is dark (arround 7 pm), my
friend didnot know that was a ticket.(this is her first time to have a car accid
ence) The reason give her ticket is that the policeman thought she came from
East to West on Rd B. She did not stop and was hit. The policeman got this point
because he talked to a teenage driver who was behide of the car which hit my 
friends. Actully the teenage did not see all this happened, he arrived after theaccidence happened. The policeman said the teenage said he saw my friend come
from Rd B. (latter my friend talk to the teenage on the phone and ask him what 
he said to policeman. He denied he said that).
  Now my friend will go to court to meet police man to get the justic back. Thisis not her fault. She should not have a ticket. 
  I know this net about Lad. My friend really need help about this accidence 
because she never has a experience before. I am really appreciated for any help and any advice. My friend have some things quite unclear:
1. How can she win this case? Now she has a ticket from policeman.
2. 
2. She has a note with a signature of that teenage to claim he never says he sawmy friend on Rd B. But he doesn't want to go to court with my friend to be wait-ness for what he writes.
3. What should she do to let judge know the truth and not to influence with the policeman's report? What kind of evidence should she prepare for?
4. Does she need a lawyer to go the court with her?

I send this mail to net after thinking for a long time. I really feel it is 
unfair and get very ungry for it. This is not my friend fault and she got a 
ticket. Where is Justic? Please give her a hand. She needs every person's help.

I feel sorry for your friend. I do feel there might be some discrimination
against foreign students in the policemen mind. In Duke I know some accidents
which involved chinese students and american were solved wrongly by the police.
In one of the cases, the chinese student went to the international office to
ask help. The international office hired a lowyer for the student for free. The
case was finally solved and justice was brought back. So my suggestion is to
find a layer. I don't know about your area, in Durham area after each accident
you would most probably got letters from local law firms asking wether you need 
help or not. Those lawyers are living on helping people who got involved into
car accidents and need help. The worst you would expect is to lose the case 
and pay the lawyer several hundred dollars. But since the policeman couldn't
find a witness, I guess you can get higher probability to win.

Hi:
  Thank you so much for everybody's kind reply of my questions about my
friend's car accidence. It really empress me about all of your warm and idea. I 
also want to say thank you for my friend. She is going to go to the court soon. 
Are there any persons familar with the traffic court of accident?  There is
some questions concerning about court:
 
  1. Who should attend the court? Are they district atoney, other driver and
police officer? If the waitness does not go, can police officer subpoena him?

  2. In the court, at the begining,  does the judge ask whether there is a
person who want to go to traffic school? If she says yes, does that mean even
she is guilty, there is no point for her in the future?

  3. If she lost the case, should she pay money for it? Does she have to pay
the money to police officer and district atorney?

Heard from a CA friend that it moved up to July 8 according to World 
Journal of Sept. 10. Could anybody confirm me this?
