Failure to Credit Fees
It seems like everyone is asking about the writing of policies and
procedures for archives these days, and I am joining in on the bandwagon
with a question of my own.
Jeffrey Cramer posted a message asking for fee schedules from archives
earlier this week. Shelly Kelly (great name, by the way), linked the
Rosenberg Library site's "Reproduction Policy for Materials". I was looking
through it and noticed that in connection with the credit line for
photographs the sentence, "Failure to credit the Rosenberg Library will
result in a penalty of $100.00 per image published or exhibited."
Can anyone elaborate on this? How does an archive go about collecting such a
penalty? Is there a legal basis for this as well? Any information would be
appreciated!
