Re: "permanent loan" vs "gift"

Dear Jeff:

I am surprised that you want to consider arranging a permanent loan (the
term itself is an oxymoron). At the historical association we are attempting
to convert our permanent loans into gifts or annually renewable loans. We
have had problems in tracking donors who gave an item under permanent loan
thirty, forty years ago. I would advise against such an arrangement (see
Marie Malaro's "A Legal Primer on Managing Museum Collections"; she makes a
good case against permanent loans). Renewing a loan every year increases the
chances that the loan will become a gift. If you do want to persist I
suggest looking at the Texas Association of Musuem's publication "The Museum
Forms Book" (or something to that effect). However, as most museums are
shying away from arranging permanent loans, I think it is unlikely that you
will find such a form.
