TRENTON -- It took two years of wrangling and thousands of dollars in legal
fees before the state attorney general agreed last week to release the more
than 50,000 documents that led Gov. Christie Whitman to concede state
troopers were guilty of racial profiling.
Despite strong public interest, most of the documents were off limits to the
public, shielded by New Jersey's antiquated public records law, one of the
most restrictive in the nation. Attorney General John J. Farmer Jr.,
apparently throwing in the legal towel, will allow the public to see the
documents next month.
Many argue it shouldn't be up to the discretion of the attorney general. It
should be the law.

The embattled Frogtown Puzzle Co. and its parent organization, the Frogtown
Action Alliance, have agreed to turn over financial records for review,
according to St. Paul officials.
So far, however, the city has not received word from Shem Shakir, alliance
president, about when the records would be made available.
A letter from Shakir, which was sent last week, broke the group's month-long
silence and the escalating tension between city officials and Shakir.

Iowa attorney general addresses problems with open records

AMES--A newspaper investigation that revealed widespread problems with the
availability of public records across the state produced results even before
it was published.
Iowa Attorney General Tom Miller and his staff decided to hold classes for
Iowa's law enforcement officers describing how to, and how not to, handle the
state's open records laws.
"We very much took notice of the general findings that local governmental
entities often didn't comply right off the bat," said Bob Brammer, Miller's
spokesman. "We thought we might as well get mobilized to strengthen training
ourselves."

Judge's order halts purge of personal property

Pascagoula -- John Ford went to the trash dumpster at the Pascagoula Public
Library on Saturday ready to dig for historical law books his family had
donated years ago to the county law library.
But BFI beat him to it. The dumpster was almost empty. And books, some with
references to cases from the 1600s, were lined up on carts inside the law
library ready to be discarded first thing Monday, according to papers filed
in Chancery Court.
So Ford and Henry Pate, the Jackson County Bar Association Law Library
Committee chairman, went to see a judge.

Payne County election board secretary resigns

STILLWATER - Payne County Election Board Secretary Bernice Mitchell pleaded
guilty Thursday to one count of destroying public records and was given a
one-year deferred sentence.
As part of a plea bargain, she agreed to resign her post and pay $894.40 in
restitution to the Payne County Election Board and to pay court costs.
The resignation is effective at 5 p.m. Friday. After one year, Mitchell can
apply to have her case dismissed and expunged.
The felony charge carried a maximum sentence of five years.
