FOIA and ballots

OK you legal eagles out there. I was just listening to a debate on tv
about the idea that at some future point all of the Florida ballots will
be counted by the media or researchers and "the truth will out." One of
the panelists, a lawyer, said that the ballots will never be reviewed by
outsiders because they are not subject to FOIA and will be destroyed in
the not too distant future. Another lawyer on the panel disagreed saying
that indeed the ballots are subject to FOIA and may in fact be reviewed by
outsiders when the court battles are over.

I am not looking for political commentary here - just the facts please.
Anyone have an educated opinion?
