Re: FOIA and ballots



In response to Stephen Fisher's question: See following quotation from
the Florida Records Retention Schedules. Note, in Florida, we have a
strong "Government in the Sunshine" statute, but I suppose that a
majority the U. S. Supreme Court could find that such information
available to the public might prove too sensitive to be viewed.

STATE OF FLORIDA. Division of Library and Information Services Bureau of
Archives and Records Management. GENERAL RECORDS SCHEDULE GS3 FOR
SUPERVISORS OF ELECTIONS. Issue Date: May 1999.

ABSENTEE BALLOT ENVELOPES:  FEDERAL OFFICE                                              Item# 102
This record series consists of the envelope with the voter's certificate
that is signed by the absent elector pursuant to section 101.64, F.S.
RETENTION;
a)  Record copy.  22 months after certification of election.
b)  Duplicates.  Retain until obsolete, superseded or administrative
value is lost.

AFFIDAVITS/AFFIRMATIONS:  EXECUTED AT POLL (FEDERAL OFFICE)                             Item# 1
This record series consists of  affidavits/affirmations executed by the
voter at the polls to modify or reinstate voter registration at an
election for Federal office.  The record series includes "Signatures
Differ," section 101.49, F.S., "Declaration to Secure Assistance,:
section 101.051, F.S., "No Identification," section 98.471, F.S.,
"Change of Legal Residence" and "Change of Name", section 101.045, F.S.,
"Absentee Affidavit", section101.69, F.S., "Ballot Inspection", section
101.5610, F.S., and may contain "Reinstatement of Voter", section
97.091, F.S. (obsolete).  The retention period is pursuant to Title 42,
U.S. Code 1974.  See also "CHANGE OF RESIDENCE RECORDS," "CHANGE OF NAME
RECORDS" and/or "DECLARATION TO SECURE ASSISTANCE RECORDS."
RETENTION:
a) Record copy. 22 months after certification of election.
b) b)  Duplicates.  Retain until obsolete, superseded or administrative
value is lost.

BALLOTS, OFFICIAL: FEDERAL OFFICE                                                       Item# 11
This record series consists of record cards, voting machine ballot
cards, except when reference is made to write-in ballots, paper ballots,
electronic or electromechanical tabulation cards and other ballot
materials. These records are created pursuant to section 101.5609, F.S.
The retention period is pursuant to Title 42, U.S. Code 1974.
RETENTION:
a)  Record copy.  22 months after certification of election.
b)  Duplicates.  Retain until obsolete, superseded or administrative
value is lost.
