Listserv Archives Policy



I have a question for this group.

I moderate a list with 1500 subscribers. There has been an archive
of all postings to the list since its inception in 1994. Subscribers are
made aware of this archive upon subscription, and its presence (and
scope) is continually broadcast as needed on the list.

Now, there's a problem. One former subscriber wants to have their
postings expunged from the archive, and is threatening legal action
if that is not complied with. Much of this relates to things that the
complaintant wrote themselves.

My feeling is that anything posted to the list is a publication. Of
course posters own copyright over their "publications" and how they
are used in the future. Therefore, I feel under no obligation to purge
these postings.

Is anyone aware of any caselaw relating to these kinds of things?
