Re: Laws Relating to Governor's Papers

Paul Scott's citation to Texas law is correct. However the alternate
depository statute (Paul's first reference) has been the subject of widely
different interpretations. The Texas State Library and Archives Commission
has requested a Texas Attorney General's opinion on the statute. See

Subject: FW: Laws Relating to Governor's Papers

David Smolen asked:
Fellow Archivists: Is anyone aware of laws anywhere in the country that
relate to the papers of a governor? Governor's pretty much have free reign
over their papers, don't they? Do any States have something equivalent to
the Presidential Records Act? Thank you for your thoughts.

For the law permitting Texas governors to place their papers in depositories
other than the State Archives see:
http://www.capitol.state.tx.us/statutes/go/go044100.html#go104.441.201
(§441.201 of the Government Code).
For the law exempting certain papers of the governor from the Public
Information Act (formerly Open Records Act) see
http://www.capitol.state.tx.us/statutes/go/go055200.html#go029.552.106
(§552.106 of the Government Code).
It is likely that other sections of Texas law also address governor's papers
but these are the only two I know of off the top of my head.
