Re: LP covers

At least according to the wisdom of Kinko's (for what that's worth!), this
would indeed be a copyright issue unless the albums were issued by your
organization and you gave permission. During the early 90s, I was librarian
at a residence hall library at the University of Michigan. We had a big
collection of CDs, and the way we provided access to them was to display
photocopies of the covers in clear plastic sleeves. Library patrons would
browse through the covers and then request the CD they wanted to borrow at
the circulation desk. Since we only had access to a black & white
photocopier at the library, we wanted to make color photocopies of the album
covers at the local Kinko's but were told that would not be permitted (even
for use in the library) due to copyright law.

Having been the target of some copyright-related lawsuits in the past, I
think Kinko's takes a very conservative line on this stuff now, so perhaps
they were being overprotective.

Subject: LP covers

Has anyone dealt with a request to photograph the covers of LP records, for
publication in a book? I have a gentleman coming who wants to have our LP
covers copied photographically. He plans to self-publish the book for sale
to collectors. Some of the LP's were produced by this museum, but I know
some will be from defunct labels, or labels now owned by another company.

Would this fall under "fair use"? Or will he need to negotiate copyright
with the owner of the label, and perhaps with whoever did the art? And
perhaps whomever wrote the notes?

Thanks in advance for any cautionary tales/advice.
