Re: LP covers



I suspect the Rock-n-Roll Hall of Fame, Cleveland, has faced this issue.
Unless the display has changed, there is a fantastic room where one can
listen to musical artists from various decades. On the wall is the most
amazing collection of LP covers....worth the price of admission just to see
them, floor to ceiling.

I recall also a photographer, who,without permission, took a fantastic photo
of the Rock Hall by night. He sold some posters of this photo, and the
response was so great, the posters were selling like hotcakes. I'm sure most
of you have seen it. When the photographer started making some big money
from this, I think the city of the Hall stepped in, and if memory serves me
correctly, it went to court. I don't recall the exact outcome, but I thought
some agreement was reached giving the Hall or the city some percentage of
the take.  It was an interesting case.

Has anyone dealt with a request to photograph the covers of LP records, for
publication in a book?  I have a gentleman coming who wants to have our LP
covers copied photographically.  He plans to self-publish the book for sale
to collectors.  Some of the LP's were produced by this museum, but I know
some will be from defunct labels, or labels now owned by another company.

Would this fall under "fair use"?  Or will he need to negotiate copyright
with the owner of the label, and perhaps with whoever did the art?  And
perhaps whomever wrote the notes?

Thanks in advance for any cautionary tales/advice.
