Electronic Signatures & Records Act (ESRA) :  Unleashing the Potential
of Electronic Commerce

The Program. Until recently, there were real and perceived barriers to
conducting many types of electronic commerce. Contracting for services,
applying for a driver's license or applying for a job all require a
signature. Most people assume that "to be legal" a contract, application
or similar record must be in paper form with a handwritten pen and ink
signature. In order to remove such barriers, the Electronic Signature
and Records Act (ESRA) was signed by Governor Pataki last September.
ESRA establishes a new body of State law for technology. It also
provides a mechanism for state and local government agencies to develop
government electronic commerce and other information technology based
systems that rely on electronic signatures and electronic documents, and
gives these mechanisms the same force in law as paper based signatures
and records.  ESRA will have a major impact on management of electronic
records in both the private and public sectors.

What you will learn.  This presentation will discuss ESRA's components,
recent progress in implementing the act, and its likely impact on
records and information managers in the public and private sector.

The Presenter.  Alan S. Kowlowitz is presently a Program Technology
Analyst with the New York State Office of Technology (OFT). He is a
member of the Electronic Signatures and Records Act (ESRA) Team. ESRA
provides that "signatures" made via electronic means will be legally
binding just as hand-written signatures now are. The law also enhances
and clarifies the authority of government to create and retain
electronic records. The ESRA Team serves as the Electronic Facilitator
responsible for promulgating rules and regulations for programs
authorized by the bill.  Alan was previously the manager of the
Electronic Records Services (ERS) in the New York State Archives and
Records Administration (SARA), where he worked from 1979 to 1999.  He
has specialized in electronic records management issues since 1985.
Allan has also published in this field and served as an electronic
records management consultant to a number of states and to the National
Archives and Records Administration's (NARA) Electronic Records Work
Group (ERWG).
