What can be the legal ramifications of this? What were the
responsibilities of the custodians?
Wellllll probably depends upon
what was in the RFP, the contract and the statement of work. Don't mean to be
flippant. If outsourcing is going to done then all aspects must be
examined carefully. All contingencies must be identified. Every aspect of the
business to be outsourced must be examined carefully and minutely because once
the contract is signed the vendor will say "Sorry, Jack. That wasn't in the
contract" when a problem arises that was not previously identified. This points
out again how necessary it is for fully utilizing an organization's resources
when developing an RFP or developing a contract/agreement. Use your financial
folks, involve the attorney, etc.
