You might want to look at the model license
agreement developed by a group of Arizona archivists and museum folk at http://www.hanksville.org/sand/contacts/lic.intro.html
The form includes language that requires
anyone who reproduces materials obtained from the archives to hold the archives
harmless and to indemnify the archives for any and all expenses related to the
use of the image.
While contractually binding, such that an
individual would have to reimburse the archives if the archives is sued, the
problem is that the individual may go bankrupt--leaving the archives to pay the
damages. It's better than nothing.
